Compromise between parties allows quashing of proceedings under IPC and SC/ST Atrocities Act.

COMMON ORDER:

This Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, ‘ Cr.P.C .’) by the petitioners, who were arrayed as accused Nos.1 and 2, seeking to quash the proceedings in S.C.No.100 of 2022 on the file of Special Sessions Judge for SC/ST cases-cum-VIII Additional District and Sessions Judge, Nizamabad, for the offences punishable under Sections 448 , 427 and 506 of the Indian Penal Code, 1860 and Sections 3 (1)(r)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention Of Atrocities) Amendment Act, 2015 .

2. Heard Mr.A.Bhuvan Sunder Reddy, learned counsel for petitioners, Mr.M.Vivekananda Reddy, learned Assistant Public Prosecutor for respondent No.1 and Mr.B.Manav Kumar, learned counsel for respondent No.2.

During the pendency of this criminal petition, at the intervention of well-wishers and elders, petitioners/accused Nos.1 and 2 and respondent No.2/de-facto complainant have entered into compromise to resolve the disputes pending between them and filed joint affidavit along with I.A.No.2 of 2025 and also filed another I.A.No.1 of 2025 to record the compromise and to compound the offences.

The above said applications came up for consideration before this Court on 19.09.2025, and this Court directed the petitioners/accused Nos.1 and 2, and respondent No.2/de- facto complainant, to appear before the Secretary, Telangana High Court Legal Services Committee, along with their identity cards for their identification, on or before 24.09.2025, and further directed the Telangana High Court Legal Services Committee to submit a report by 08.10.2025. Pursuant to the same, Telangana High Court Legal Services Committee submitted report dated 24.09.2025.

Taking into consideration the above facts and circumstances including joint memo filed by both the parties, proceedings in S.C.No.100 of 2022 on the file of Special Sessions Judge for SC/ST cases-cum-VIII Additional District and Sessions Judge, Nizamabad, against the petitioner/accused Nos.1 and 2 are liable to be quashed.

6. Accordingly, I.A.Nos.1 and 2 of 2025 are allowed. Consequently, the criminal petition is allowed and the proceedings in S.C.No.100 of 2022 on the file of Special Sessions Judge for SC/ST cases-cum-VIII Additional District and Sessions Judge, Nizamabad, against the petitioner/accused Nos.1 and 2 are hereby quashed.

Pending miscellaneous applications, if any, shall stand closed.
