Court directed respondents to act on the petitioner's application for boundary demarcation under established legal protocols.

ORDER

This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents 4 & 5 in not considering the application for appeals on demarcation through No.AOD022500074064, dated 06.08.2025 and not conducting survey, demarcation and not fixing the boundaries to the petitioner’s agriculture land to an extent of Acs.0.23 guntas in Sy.No.42/Aa/1, situated at Amangal Village and Mandal, Ranga Reddy District (hereinafter will be referred to as ‘subject property’) as illegal, arbitrary and consequently, to direct the respondent Nos.4 & 5 to consider the aforesaid online application.

2. Heard learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue.

3. Learned counsel for the petitioner would submit that on the application made by the petitioner herein, necessary survey, as sought by the petitioner has been conducted. Accordingly, survey report dated 27.11.2021 was furnished by the 5^th respondent/Tahsildar, where the petitioner’s land has been demarcated. Aggrieved by the same, petitioner has made an online application under the provisions of Bhu Bharathi Act under module ‘Appeals on Demarcation’ vide transaction ID TTAOD022500074064, dated 08.06.2025 in respect of TS RY043-1. Despite receiving and acknowledging the same, the respondents 4 & 5 did not act upon the same. Aggrieved by the inaction on the part of the respondents 4 & 5, petitioner filed the present writ petition.

On the other hand, Sri L.Ravinder, learned Assistant Government Pleader for Revenue, on instructions, would submit that the application of the petitioner would be considered in accordance with the circular Roc.No.N1/1408/07, dated 13.07.2007 and Rc.No.N2/1741/2010, dated 18.05.2010 issued by the Commissioner of Survey, Settlement and Land Records and necessary orders will be passed, strictly in accordance with law.

In the light of the said submission of the learned Assistant Government Pleader for Revenue, without expressing any opinion on the merits or demerits of the case, this Court deems it proper to direct the official respondents to act upon the online application made by the petitioner herein under ‘Appeals on Demarcation’ No.AOD022500074064, dated 08.06.2025 and take appropriate action, strictly in accordance with law, in terms of the circulars as stated supra, by putting the petitioner and all other interested parties on notice and afford an opportunity of hearing. He shall complete the said exercise within a period of 45 working days from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
