H eard Sri P. Venu Gopal, learned Senior Counsel and Sri M.

Srikanth, learned counsel representing Sri G. Nanda Gopal, learned counsel for the appellant and Sri S. Raghu Ram, learned counsel representing Ms. K. Sri Devi, learned counsel for the respondent.

2. Feeling aggrieved and dissatisfied with the order and decree dated 12.09.2012 in F.C.O.P.No.1443 of 2009 passed by the learned Judge, Family Court, Hyderabad, appellant-husband preferred F.C.A.No.356 of 2012.

3. Respondent-wife had filed the aforesaid F.C.O.P.No.1443 of 2009 against the appellant-husband seeking dissolution of marriage on the ground of cruelty.

4. Likewise, appellant-husband has filed F.C.O.P.No.3 of 2011 against the respondent-wife to restore the custody of minor child namely Ayushmi. Vide impugned order dated 12.09.2012, learned Judge, Family Court, Hyderabad dismissed the said O.P. Feeling aggrieved by the said order and decree, appellant-husband has preferred F.C.A.No.2 of 2013.

5. The marriage of appellant-husband with respondent-wife was performed on 16.10.2002 as per Hindu rites and customs. It is an arranged marriage. They blessed with a girl child namely Ay
