ORDER:

Questioning inaction on the part of the respondents No.1 to 5 in taking action upon the petitioner’s complaint dated 07.10.2025, petitioner filed the present writ petition with a consequential prayer to a) To direct the respondents No.3 to 5 to forthwith register an FIR against Smt. Chirumamilla Gowthamy, Mr. D.H.V.S.S.N. Murthy, and other involved persons, including colluding police officials, based on the Petitioner complaint and evidence, including the eight-hour audio recording, and to conduct a fair, impartial, and expeditious investigation into the allegations of illegal phone tapping, unauthorised digital surveillance, installation of spy cameras, blackmail, extortion, criminal intimidation, voyeurism, breach of privacy and criminal conspiracy.

b) To direct the respondents No.1 and 2 to exercise supervisory powers under the law and ensure compliance by the police authorities with the statutory obligations, including monitoring the investigation to prevent any bias, influence, or further collusion, and to submit a status report to this Hon'ble Court within a time-bound period as may be deemed fit.

c) To direct the respondent 1 and 2 to constitute of an independent Special Investigation Team (SIT) under the supervision of this Hon'ble Court, comprising officers of unimpeachable integrity from outside the Telangana State Police, to probe the allegations, including the role of police officials in the alleged collusion and extortion demands, and to complete the investigation within a stipulated timeframe, such as three months, while ensuring the preservation and forensic examination of all evidence, including digital records, CDRs, and the Petitioner's audio recording.

d) To declare the acts of illegal interception, recording, and dissemination of the Petitioner private communications, visuals, and data by the accused persons as unconstitutional and in violation of the Petitioner fundamental right to privacy under Article 21 of the Constitution, and direct the official Respondents to take immediate steps to prevent further violations, including enforcement of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, for removal of such unlawful content from digital and media platforms and not to publish, print or transmit telecast about the petitioner personal information related to the breach of privacy.

2. Brief facts of the case are that the petitioner is an actor and owner of a chain of restaurants across Telangana and Andhra Pradesh. The Petitioner and his legally wedded wife, Smt. Chirumamilla Gowthamy, who is the respondent No.6 herein, have been residing separately since January, 2025 due to personal and matrimonial disputes. During this period of estrangement, the respondent No.6 conspired against the petitioner in collusion with a television news reporter, Mr. D.H.V.S.S.N.Murthy, who is the respondent No.7 hrein, whom she met on several occasions. The respondent No.6, with the assistance and technical resources of the respondent No.7, secretly recorded private visuals, conversations and confidential activities inside the petitioner’s home illegally without his knowledge or consent. It is further submitted that the said individuals have engaged in illegal digital surveillance by unlawfully accessing the Call Detail Records (CDRs) and location data of the Petitioner and his family members, thereby infringing their privacy and security. The phone numbers subjected to such illegal access and monitoring include: Petitioner's numbers: 9114319999 and 9016939999, Father's numbers: 9396722446 and 9675544999, Family members: Kakani Bhagya Lakshmi (9115434567/9888475678) and Kakani Aruna (9396614545/9581293056). 3.
