ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

2. Heard Sri Veera Savan Chakravarthy Dara, learned counsel for the petitioners and Sri L.Ravinder, learned Assistant Government Pleader for Revenue, for respondent Nos.1, 5 to 7 and perused the record.

3. Learned counsel appearing for the petitioners would submit that the petitioners are farmers and residents of Indaram Village in Jaipur Mandal, Mancherial District, eking their livelihood by doing agriculture. Respondent No.1 had constructed the flyover in the year 2022, on the SH.No.1 at Indaram Village, Mancherial District to facilitate respondent No.2 – SCCL Company to dump the over burden mud extracted by the Indaramkhani Open Cast Mine.

4. Respondent No.2 had laid road under the flyover bridge and fenced the entire area Indaram Villgae, restricting the movement of the petitioners to approach their agricultural lands and the main road i.e., SH.No.1. The authorities of respondent Nos.1 and 2 had assured the petitioners having land in Indaram Village, that service roads shall be constructed along with the flyover bridge, to facilitate the farmers to access and approach their agriculture lands and the main road but respondent No.1 had completed the construction of flyover bridge but did not construct the service roads as assured and respondent No.2 had constructed road under the flyover and fenced the entire area and blocked the existing road which the farmers used to commute, due to which the petitioners are not able to commute and approach their agricultural lands and cultivate since the service road is not constructed and road used by the farmers earlier to the construction of the flyover bridge is blocked now. The action of respondents in not considering the representations submitted by the petitioners to construct service road along the newly constructed flyover in Indaram Village so as to facilitate their access and approach to the agricultural lands is arbitrary and illegal. Hence, the present writ petition.

5. Learned Assistant Government Pleader for Revenue would submit that the respondent-authorities will consider the case of the petitioners and pass appropriate orders in accordance with law.

6. In the light of the aforesaid facts and circumstances of the case and upon perusing the material available on record, this writ petition is disposed of, directing the official respondents to consider and examine the representations submitted by the petitioners, strictly in accordance with law by putting the petitioners and all affected parties on notice and affording them an opportunity. If respondent-authorities are not inclined to accept the request made by the petitioners, they shall pass an order assigning specific reasons and communicate copy of the said order to the petitioners. They shall complete the entire exercise as expeditiously as possible and in accordance with law. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending, shall stand dismissed.
