ORDER

This writ petition is filed by the petitioner seeking to declare the action of respondent Nos.2 to 4, in refusing to cancel the building permission granted to respondent Nos.5 to 7 vide permit Nos.0207/PERZ/IABP/2025 (File No.003400/PER/00054/ IABP/2025), and 0208/PERZ/IABP/2025 (File No. 005190/PERZ/ 00075/IABP/2025), dated 07.10.2025, as arbitrary and in violation of Articles 14 and 21 of the Constitution of India.

2. Heard Mr. Pranay Sohini, learned counsel for the petitioner, and Mr. Putta Krishna Reddy, learned Standing Counsel appearing for respondent Nos.2 and 3, and perused the material available on record.

Learned counsel for the petitioner submitted that respondent No.2 Corporation granted building permission to respondent Nos.5 to 7 vide permit Nos.0207/PERZ/IABP/2025 and 0208/PERZ/IABP/2025, dated 07.10.2025, even when perpetual injunction decree dated 18.01.2018 was passed in O.S.No.1105 of 2008 on the file of the II-Additional Senior Civil Judge, Ranga Reddy District, instituted by the petitioner against the vendors of respondent Nos.5 to 7 who are arrayed as defendant Nos.2 and 11 in the suit. The complaint dated 30.10.2025 lodged by the petitioner not to grant building permission to unofficial respondents, has not been entertained.

4. Learned Standing Counsel for respondent Nos.2 and 3 submitted that building permission has already been granted to respondent Nos.5 to 7, thus the question of entertaining the complaint of the petitioner not to grant building permission to respondent Nos.5 to 7 does not arise.

5. As it is stated that there is a decree in O.S.No.1105 of

2008 in favour of the petitioner and against the vendors of respondent Nos.5 to 7, the petitioner is granted liberty to submit an application under Section 176 (9) of the Telangana Municipalities Act, 2019, for cancellation of building permission dated 07.10.2025 granted to respondent Nos.5 to 7 vide permit Nos. 0207/PERZ/IABP/2025 and 0208/PERZ/IABP/2025. Upon such application being filed, respondent No.2 shall forthwith act upon the same and pass necessary orders within a period of three (03) weeks thereafter, by affording an opportunity of hearing to the petitioner and respondent Nos.5, 6 and 7.

6. Accordingly, this writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition stand closed.
