In this Writ Petition, the petitioner is challenging the action of

respondents 2 to 6 in not allowing the petitioner society to transport the

de-silted sand from the Kodimuthaiahgumpu Village, Manuguru

Mandal, Bhadradri Kothagudem District, as illegal and arbitrary.

2. It is submitted that the petitioner has entered into an agreement

dt.12.05.2025 with respondent No.7 for de-silting of sand and has

undertaken transportation of the de-silted sand to the stock point and

since there was only one way, i.e., through the forest, the petitioner has

undertaken the transportation through it and he submitted that the Forest

authorities were also permitting the transportation by collecting a fee/tax

of Rs.100/- per lorry, but however, suddenly, on 21.12.2025 the subject

route was blocked without any reason though there was no complaint

against the transporters regarding violation of any of the provisions of

the Forest Act or the Mining Act and therefore, the petitioner has filed

the present Writ Petition.

3. Learned Government Pleader for Forests has obtained written

instructions, according to which, the proposal for development of

temporary use of old path way for short period for movement of sand

transport vehicles from Gonugula plantation to R&B Road is pending

with the Principal Chief Conservator of Forests, Telangana, Hyderabad

and that the issue is under consideration of the authorities.

4. Learned counsel for the petitioner, however, submitted that by

collecting fee/tax of Rs.100/-, the respondents were permitting sand

transport vehicles earlier and therefore requested that the same

procedure may be directed to be followed till the petitioner completes

the transportation of its allotted permitted quantity of stock.

5. In view of the above, this Court directs the respondents to permit

the petitioner to transport the de-silted sand through the subject route till

its permitted quantity is over or till a decision is taken by the respondent

authorities, whichever is earlier, by collecting the requisite fee as being

done earlier.

6. With the above direction, the Writ Petition is disposed of. No

order as to costs.

7. Pending miscellaneous petitions, if any, in this Writ Petition shall

stand closed.
