O R D E R :

This Writ Petition, under Article 226 of the Constitution of

India, is filed seeking the following relief:

“…to issue Writ, order or direction particularly one in the nature of WRIT

OF MANDAMUS, declaring the action of respondents in not considering

the representations dated 20-02-2024, 06-04-2024, 20-02-2025, 30-05-

2025 and not paying the terminal benefits of late K.Nageswara Rao and

not fixing and paying family pension to the petitioner due to death of her

husband K.Nageswara Rao (Pension payment order No.10-S-007194), as

illegal, arbitrary and violative of principles of natural justice direct the

respondents to consider the applications/representations dated 20-02-

2024, 06-04-2024, 20-02-2025, 30-05-2025 of petitioner and determine

the terminal benefits as well full pension of late K.Nageswara Rao and fix

and pay family pension along with all arrears of terminal benefits,

pension and family pension, and to pass…”

2. Heard Sri Manoj Kumar, learned counsel representing Sri

Sreenivasa Rao Velivela, learned counsel for the petitioner; learned

Government Pleader for Services-II for respondent Nos.1 and 2;

learned Government Pleader for Services-I for respondent No.3; and

learned Government Pleader for Services-III for respondent No.4.

With their consent, this Writ Petition is taken up for disposal at

admission stage itself.

3. Learned counsel for the petitioner submits that the petitioner’s

husband served as Superintending Engineer, RWS Project Circle (PR),

Kakinada, and retired from service on 30.06.2004 on attaining the

age of superannuation. It is further submitted that the petitioner’s

husband expired on 02.02.2024 due to ill-health. As such, the

petitioner submitted a representation to respondent No.2 on

20.02.2025 requesting the grant of family pension and release of

pensionary benefits pursuant to the demise of her husband.

However, no action has been taken by respondent No.2 so far.

Therefore, learned counsel prays this Court to direct respondent No.2

to consider the representation dated 20.02.2025 submitted by the

petitioner and release family pension and pensionary benefits, within

a time-frame to be stipulated by this Court.

4. Learned Government Pleader appearing on behalf of respondent

Nos.1 and 2 fairly submits that respondent No.2 will consider the

petitioner’s representation dated 20.02.2025 and pass appropriate

orders, in accordance with law.

5. Having regard to the submissions made by learned counsel for

the respective parties and without going into the merits of the case,

this Writ Petition is disposed of, directing respondent No.2 to consider

the representation dated 20.02.2025 submitted by the petitioner and

pass appropriate orders thereon, strictly in accordance with law, as

expeditiously as possible, preferably within a period of four (4) weeks

from the date of receipt of a copy of this order and communicate a

copy of the decision to the petitioner.

Miscellaneous applications, if any, pending in this Writ Petition,

shall stand closed. There shall be no order as to costs.
