This Writ Petition is filed challenging the action of respondents

No.2 and 4 in initiating proceedings against the petitioner under the provision of Telangana Gram Panchayat Act, 2018, after permitting the petitioner to construct a poultry shed in Sy.No.106/AA/3, situated at Regunta Village, Mallapur Mandal, Jagityal District, vide Lr.D.Dis.No.2462/ 128/2025/W dated 24.02.2025 as illegal and arbitrary and consequently to direct respondent No.4 not to take any

further coercive steps against the petitioner and to pass such other order or orders.

2. Heard Sri A. Ravinder Reddy, learned Senior Counsel representing Sri Ch. Venkateshwara Reddy, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent No.1, learned Government Pleader for Municipal Administrative and Urban Development appearing for respondent No.2, learned Assistant Government Pleader for Irrigation and Command Area Development appearing for respondent No.3 and Sri K. Pradeep Reddy, learned Standing Counsel for Gram Panchayat appearing for respondent No.4.

Learned Senior Counsel appearing for the petitioner submitted that the petitioner was granted permission to construct a poultry shed vide proceedings dated 24.02.2025 and accordingly, the petitioner had constructed the poultry farm. Learned Senior Counsel further submitted that the respondents stated that the petitioner was required to obtain a No Objection Certificate (NOC) from the Irrigation Department and the petitioner has accordingly made an application dated 02.07.2025 to the Irrigation Department. The grievance of the petitioner is that while the said application is under consideration, the respondents have issued the impugned notices dated 28.10.2025 and 17.11.2025 for taking action against the construction made by the petitioner. Learned Senior Counsel submitted that the petitioner is not going to make any further construction till the No Objection Certificate is received from the Irrigation Department and till such time, he is seeking a direction to respondents No.2 to 4 not to take any coercive steps against the construction already made by the petitioner.

Learned Assistant Government Pleader for Irrigation and Command Area Development, appearing for respondent No.3, furnished a copy of the written instructions received by him, according to which the petitioner has made an application for issuance of a No Objection Certificate from the Irrigation Department and that the same is under consideration. It is further stated that a letter was addressed to the Tahsildar, Mallapur, requesting to depute the Mandal Surveyor to carry out fixation and demarcation of boundaries and to furnish the location map of the said poultry farm from the canal boundary, to facilitate issuance of the No Objection Certificate.

In view of the above submissions, this Court deems it fit and proper to dispose of this Writ Petition at the admission stage, with a direction to respondents No.2 and 4 not to take any coercive steps against the building of the petitioner till a decision is taken by the Irrigation Department on the issuance of No Objection Certificate.

6. With the above directions, the Writ Petition is disposed of.

There shall be no order as to costs.

7. Miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
