Between:

AND

The State of Telangana,

Represented by Principal Secretary,

…Respondents

ORDER: (ORAL)

This writ petition is filed by the petitioners seeking to declare the

inaction of respondent Nos.3 to 6 in considering the representation dated 22.03.2025 submitted by them as illegal, arbitrary and consequently prayed to direct respondent Nos.3 to 6 not to make any constructions of permanent dividers on the road from Baruq Jung Masjid to Naaz Hotel

in Petla Burz.

2. Heard Mr. C.Naresh Reddy, learned counsel for the petitioners; Mr. Raparti Venkatesh, learned Standing Counsel for GHMC, appearing for respondents Nos.3 to 5; learned Assistant Government Pleader for

Home, appearing for respondent No.6; and perused the material on record.

3. It is stated that the petitioners are the residents of Petla Burz area and they regularly use the road from Baruq Jung Masjid to Naaz Hotel in Petla Burz on day-to-day basis for their personal and business needs. It is submitted that the road on which the construction of dividers is being carried out is a narrow thoroughfare, where the width ranges from 22 to 28 feet. The construction of dividers on such a road would further constrict its width and thereby cause traffic congestions and impede smooth vehicular movement. The said road serves as a principal and single route connecting Madina to Bhadurpura and is invariably busy throughout the day. Several heavy vehicles such as trucks and buses pass through this road for transit. The construction of dividers in this road would result in severe traffic congestions, delays and increased risk of accidents. Therefore, the petitioners submitted representation dated 22.03.2025 to respondent No.4 requesting to visit the site personally and take necessary steps in the interest of public. However, the said representation was neither considered nor addressed by the respondent authorities.

4. Learned Standing Counsel for GHMC and learned Assistant Government Pleader for Home submitted that respondent No.3-the Zonal Commissioner, GHMC, Charminar Zone, Hyderabad, addressed letter dated 20.01.2025 to the Deputy Commissioner of Police, Traffic-III, Hyderabad, stating that the GHMC has started beautification and development of central median work from City College Junction to Puranapool Darwaza in Circle No.9, CRZ, GHMC, Hyderabad. Due to heavy vehicular movement and for the convenience of the commuters, “U” turns are required in the following places, i.e., 1) Opp. MTO; 2) Opp. Rasheed Khan and Sons Sanitary Home; 3) Opp. CAR Headquarters Gate No.2; and 4) Opp. CAR Headquarters Gate No.1. Further, it was also found that there are some gaps between road and footpath, which is for flow of water from Puranapool Darwaza to City College and it requires leveling of the road by filling up with the Asphalt for free flow of traffic and thus, request was made to the Traffic Police to provide “U” turns on the above places and level the road by filling with asphalt/tar from Puranapool Darwaza to City College for free flow of traffic and to avoid traffic jams. Further, another letter dated 19.02.2025 has been addressed by respondent No.3 to the Deputy Commissioner of Police, Traffic-III, Hyderabad, stating that after opening of Dr. Manmohan Singh Expressway Bridge, the vehicular movement has increased. Moreover, in this road, the VIPs, i.e., the Hon’ble High Court Judges are passing regularly and are facing inconvenience. Leaving of construction material on the road is leading to frequent accidents and to avoid such traffic congestions and accidents, Central Median construction work is required to be completed and thus, the Deputy Commissioner, was directed to complete the Central Median from City Coll
