ORDER:

This Writ Petition (TR) is filed under Article 226 of the

Constitution of India, seeking the following relief:

“…to declare the action of the Respondents in fixing the uniform

upper age limit of 44 years in the Notifications issued by the Respondents No.3 and 4, without considering the different upper age limits prescribed in the Special Rules 2005 pertaining to Ayurvedic, Unani and Homoeopathy Medical Services, in respect of Medical Officer (Contract) Posts, as arbitrary, illegal and violative of Articles 14, 16 and 21 the Constitution of India and consequently direct the Respondents to fix the upper age limit as 51 years for OC Candidates and 55 years for Reserved Candidates, by raising the Upper Age Limit by 10 years as ordered by the Government of A.P. in G.O.Ms.No .. 329, GAD, dated 27-07- 2015, with reference to the Upper Age Limit of 41 years for OCs and 45 years for Reserved Candidates provided in Special Rules 2005, pertaining to Ayurvedic, Unani and Homoeopathy Medical Services, and accordingly consider the applicants case for appointment as Medical Officer on Contract basis with all

consequential benefits. and pass such other order or orders …”

2. Today, when the matter is taken up for hearing, it is brought to the notice of this Court that the learned counsel on record appearing for the petitioner is no more.

3. Learned Government Pleader for Services – I appearing for the respondents, on instructions submits that, as reflected in the cause title, the petitioner has attained the age of superannuation. Therefore, the petitioner cannot seek appointment at the age of superannuation.

4. In view of the above made submissions, the Writ Petition (TR)

is closed.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
