ORDER:

Heard Sri Karukonda Aravind, learned counsel

appearing on behalf of the petitioner and learned Government Pleader for School Education appearing on

behalf of the respondents.

2. The petitioner approached the Court seeking prayer as

under:

“… to issue an appropriate writ, order or direction particularly a writ of mandamus declaring the refusal of Respondent No. 2 to correct the name of the Petitioner in the SSC Certificate as arbitrary, illegal, violative of Articles 14, 19(1)(a), 19(1)(g) and 21 of the Constitution of India and consequently direct Respondent No. 1 to correct the Petitioner’s name from “ARUTLA SAIKUMAR REDDY” to “ARUTLA HARSHAVARDHAN REDDY”, and further direct Respondent Nos. 3 and 4 to correct the Petitioner’s Intermediate and Degree Certificates

accordingly, and pass.”.

3. Learned counsel appearing on behalf of the petitioner submits that the subject issue involved in the present writ

petition is squarely covered by the order of this Court, dated 11.03.2025 passed in W.P.No.7436 of 2025. Hence, the petitioner is entitled for grant of relief as prayed for by the petitioner in the present writ petition as extended to the petitioner in W.P.No.7436 of 2025, dated 11.03.2025.

The learned Government Pleader for School Education appearing on behalf of the respondents on the other hand placing reliance on the averments made at para Nos.8 to 10 of the counter affidavit filed on behalf of the respondent No.2, contends that the petitioner is not entitled for the relief as prayed for by the petitioner in the present writ petition.

5. The Apex Court in the judgment reported in (2021) 7 SCC 535 in Jigya Yadav Vs. Central Board of Secondary Education at para No.194 observed as under:-

‘As regards request for “change” of particulars in the certificate issued by the CBSE, it presupposes that the particulars intended to be recorded in the CBSE certificate are not consistent with the school records. Such a request could be made in two different situations. The first is on the basis of public documents like Birth Certificate, Aadhaar Card/Election Card, etc. and to incorporate change in the CBSE certificate consistent therewith. The second possibility is when the request for change is due to the acquired name by choice at a later point of time. That change need not be backed by public documents pertaining to the candidate.”

The order, dated 11.03.2025 passed in W.P.No.7436 of 2025 had attained its finality and in view of the fact that the petitioner is seeking correction of the petitioner’s name in the SSC certificate from “Arutla SaiKumar Reddy” to “Arutla Harshavardhan Reddy’ placing reliance on the Gazette Notification issued in favour of the petitioner as per the Gazette of I ndia, dated 23.06.2018, this Court opines that petitioner is entitled for the same relief as extended to the petitioner in W.P.No.7436 of 2025, dated 11.03.2025 and hence, the pleas put-forth by the learned Government Pleader for School Education appearing on behalf of the respondents in support of respondents’ case are rejected as untenable.

7. Taking into consideration:-

a) The aforesaid facts and circumstances of the case.

b) The submissions made by the learned counsel appearing on behalf of the petitioner and learned Government Pleader for School Education appearing on behalf of the respondents.

c) The observations at para No.194 of the judgment of the Apex Court reported in 2021 (7) SCC Page 535 passed in Jigya Yadav Vs. Central Board of Secondary Education(referred to and extracted above)

d) The order of this Court, dated 11.03.2025 passed in W.P.No.7436 of 2025.

e) The Gazette of I ndia Notification, dated 23.06.2018 wherein it was explicitly notified that the petitioner who was hitherto known as ARUTLA SAI KUMAR REDDY shall henceforth be known as ARUTLA HARSHAVAR
