This transfer criminal petition is filed praying this

Court to transfer MC.No.62 of 2022 pending on the file of the Family Court cum III Additional District Judge, at Warangal, to the file of the Principal District and Sessions Judge cum Family Court, at Kushaiguda, Medchal

Malkajgiri District.

2. Heard Sri VSV Krishna, learned counsel for petitioners. None appeared for respondents.

Learned counsel for petitioners submitted that at the time of filing of MC., the petitioner No.1 used to reside in Warangal, and now she has shifted to Hyderabad for treatment of her mother who is a cancer patient and her son/petitioner No.2 who is eight years old is studying in a school situated at Secunderabad. He contended that the respondent is appearing in the FCOP case filed in Kushaiguda Court, and is avoiding notices in the present case. While advocating that respondent is also residing in Hyderabad, due to which no inconvenience would be caused if this transfer criminal petition is allowed, he prayed this Court to allow the same.

Having regard to the submissions made by learned counsel for petitioner, and on going through the material placed on record, it is noted that this transfer petition is filed to transfer MC.No.62 of 2022 pending on the file of the Family Court cum III Additional District Judge, at Warangal, to the file of the Principal District and Sessions Judge cum Family Court, at Kushaiguda, Medchal Malkajgiri District. Therefore, this Court is of the opinion that sufficient grounds are made out to allow this transfer criminal petition.

Accordingly, this Transfer Criminal Petition is allowed, and MC.No.62 of 2022 pending on the file of the Family Court cum III Additional District Judge, at Warangal, stands transferred to the file of the Principal District and Sessions Judge cum Family Court, at Kushaiguda, Medchal Malkajgiri District. The Court concerned is hereby directed to transmit the entire case file relating to MC.No.62 of 2022 after duly indexed, within a period of one (1) month from the date of receipt of a copy of this order, under the due intimation of the same to the other side. There shall be no order as to costs.

Miscellaneous applications, if any pending, shall stand closed.
