WP 25953/2025
IN THE HIGH COURT FOR THE STATE OF TELANGANA
AT HYDERABAD
THE HON'BLE SRI JUSTICE E.V.VENUGOPAL
WRIT PETITION No.25953 of 2025
Dated : 10.12.2025
Between :
Nitin Malani. … Petitioner.
And
The State of Telangana, rep. By its
Principal Secretary, Revenue Department,
Secretariat, Hyderabad.
… Respondents.
ORDER :
The present writ petition is filed by the petitioner under Article
226 of the Constitution of India to declare the action of the 3rd respondent in attempting to receive and register documents presented by the unofficial respondents 4 to 6 in respect of the petitioner’s land in Sy.No.9/A, admeasuring Ac.6.10 gts., at Solipur Village, Farooqnagar Mandal, Rangareddy District, without any valid right or title, as illegal, arbitrary and in violation of the principles of natural justice and Articles 14, 19, 21, and 300-A of the Constitution of India and further direct the 3rd respondent not to entertain or register any documents submitted by the unofficial respondents concerning the petitioner’s
property, taking into account the petitioner’s representation dated
09.08.2025.
2. Heard Sri Abu Akram, learned counsel for the petitioner, Sri L.Ravinder, learned Assistant Government Pleader appearing on behalf of learned Government Pleader for Revenue Sri K.Muralidhar Reddy, Sri Srikanth, learned counsel representing Sri VV Narasimha Rao, learned counsel for respondent Nos.4 and 5 and Sri M.Narender Reddy, learned senior counsel representing Sri P.Raghavender Reddy, learned counsel for the respondent No.6.
3. The learned counsel for the petitioner submits that the petitioner is the absolute owner and lawful possessor of the agricultural land bearing survey No.9/A, admeasuring Ac.6.10 guntas, at Solipur Village, Farooqnagar Mandal, Ranga Reddy District, having purchased the same for valuable consideration through registered sale deed No.7323 of 2006 from the original owner, Manikonda Yadaiah Goud, with subsequent mutation in revenue records and peaceful possession since acquisition. Prior to this, the vendor had executed a conditional Memorandum of Agreement dated 10.06.2004 in favour of respondents No.4 and 5, which was unilaterally cancelled by the vendor on 29.11.2006 due to their failure to discharge obligations and thereafter the petitioner settled outstanding bank dues and acquired absolute title. Notwithstanding this, respondents No.4 to 6, having no valid title or possession, conspired to dispossess the petitioner through collusive litigation, obtaining a decree in OS No.13 of 2003 and filing Execution Petition No.6 of 2024, on the file of the learned XVI Additional District and Sessions Judge, Ranga Reddy District at Shadnagar despite neither the petitioner nor his vendor being parties and are now attempting to alienate the property, while the 3rd respondent, by entertaining their documents without considering the petitioner’s representation dated 09.08.2025, is compounding the illegality and exposing the petitioner to irreparable loss, violating Articles 14, 19, 21, and 300-A of the Constitution.
(a) Learned counsel for the petitioner further submits that this Court as per order dated 29.08.2025 while ordering notices to respondent Nos.4 to 6 directed the petitioner to take steps to file claim petition in EP No.6 of 2024 on the file of the learned XVI Additional District and Sessions Judge, Ranga Reddy District at Shadnagar and also directed the 3rd respondent not to entertain any registration in respect of the schedule property pending consideration of the petitioner’s representation. Accordingly, the petitioner filed claim petition before the trial Court. In view of the above circumstances, the petitioner has no alternative remedy except to invoke the extraordinary jurisdiction of this Hon’ble Court under Article 226, and the petitioner’s claim petition in EA No.21 of 2025 in EP No.6 of 2024 is pending.
Hence, the petitioner filed the present writ petition.
4. On the other hand, Sri M.Narender Reddy, learned senior counsel appearing on be
