This Writ Petition is filed under Article 226 of the

Constitution of India seeking the following relief: “…pleased to issue a Writ order or order(s) or direction more particularly one in the nature of Writ of Mandamus, declaring the action of Respondent No.4 and Respondent No. 5 calling the petitioner to police station without informing the reason or issuing any notice as illegal, arbitrary, mala fide, contrary to Article 14 and 21 of Constitution of India and consequently direct the Respondent No. 4 and 5 not to harass Petitioner to come to police station in the interests of

justice and pass…”

2. Heard Mr. Akhil Musunuru, learned counsel representing Ms. P.M. Swapna, learned counsel for petitioner and Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent No.1 to 4.

3. The learned counsel for the petitioner submits that respondent Nos. 4 and 5 have been summoning the petitioner to the police station without assigning any reason. He further submits that, in a similar situation earlier, the petitioner had filed W.P. No. 32885 of 2025, wherein this Court directed the respondent police authorities to follow the due process contemplated under law before taking any action against the petitioner. However, the respondent police authorities are again calling upon the petitioner to appear before them. Hence, the present writ petition has been filed seeking appropriate directions.

The learned Assistant Government Pleader for Home, on instructions, submits that a crime, vide Crime No. 1057 of 2025, has been registered against the petitioner on 29.10.2025 under Sections 318(4) and 316(2) of the Bharatiya Nyaya Sanhita, 2023. He further submits that, in the earlier writ petition, there was no occasion to inform the Court regarding the registration of the said crime as it had not been registered by that date. It is clarified that the petitioner was called to the police station only for the purpose of serving notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, “BNSS”), in connection with the ongoing investigation. Accordingly, the allegation that the petitioner is being called without any lawful basis or that the police are acting arbitrarily is unfounded.

Hence, he prayed for dismissal of the writ petition.

5. I have perused the material available on record.

6. The contention of the petitioner is that the respondent police authorities are calling her to the police station without justification. On the other hand, it is explained that her presence is being sought solely for serving a notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No. 1057 of 2025.

In view of the circumstances, and as the petitioner has expressed readiness to cooperate with the process of law, the petitioner is directed to appear before the Investigating Officer, i.e., respondent No. 4, on or before 10.12.2025. Upon such appearance, respondent No. 4 shall serve the notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and thereafter proceed with the investigation strictly in accordance with law and by following due process. Equally, the petitioner is directed to cooperate with the investigation in all respects.

8. With this direction, this writ petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
