…. Respondents.
O R D E R:
This Writ Petition is filed under Article 226 of the
Constitution of India seeking the following relief:
“…To issueWrit or direction preferably Writ of Mandamus, declaring the action of the respondent No.3 in calling the petitioner to the police station without there being any crime registered against him or without any notice as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondent No.3 not to insist the petitioner to attend the police station …”
2. None appeared on behalf of the petitioner.
3. Learned Assistant Government Pleader for Home submits that the allegations regarding interference with the petitioner’s personal life and liberty are unfounded. It is contended that the respondent police have been acting strictly in accordance with law and that the petitioner has never been summoned to the police station without any lawful reason. Hence, the contention raised by the petitioner is devoid of substance, and the writ petition is liable to be dismissed.
4. I have perused the material placed on record.
5. Having regard to the prayer of the petitioner, the submissions of the learned Assistant Government Pleader, and the limitations of the police authorities even while conducting criminal proceedings, this Court deems it appropriate to direct that the respondent authorities shall not summon the petitioner to the police station without any lawful reason and shall not, in any manner, interfere with the life and liberty of the petitioner, except in strict accordance with law and by following due process.
6. With this direction, the Writ Petition is disposed of. There shall be no order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
