WRIT PETITION No.31359 of 2025

ORDER:

This Writ Petition is filed under Article 226 of Constitution

of India seeking the following relief/s:-

“…to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the Impugned Notice issued by the 6th respondent in its Proceedings File No.A3/2520/2025 dt 11.10.2025 whereby proposing to conduct the survey in Sy.No.44 of the petitioner’s property situated at Gandiguda Village, Shamshabad Mandal, Ranga Reddy District, without any notice to the petitioner during the pendency of the Civil disputes as illegal, arbitrary, unconstitutional and in violation of principles of natural justice and contrary to the provisions of the Telangana Survey and Boundaries Act, 1923 and the Rules there under as being without jurisdiction and consequently set aside the Impugned Notice of the 6th respondent by relegating the parties including

the 8th respondent to the civil court to settle the dispute…”

2. Heard K.Kiran Kumar, learned counsel for the petitioner, Mr.L.Ravinder, learned Assistant Government Pleader for Revenue representing learned Government Pleader for Revenue appearing for respondent Nos.1 to 7, and Mr.Vivek Jain, learned

counsel appearing for respondent No.8. Perused the record.

Learned counsel for the petitioner submits that the deceased husband of the petitioner purchased schedule property to an extent of Ac.3.20 guntas out of Ac.13.17 guntas in Sy.No.44 of Gandiguda Village, West Taluq, Hyderabad District under registered sale deed vide document No.1620 of 1977, dated 23.06.1977, and the authorities have also issued mutation

proceedings in favour of her husband vide proceedings dated 13.06.2020, in respect of land admeasuring Ac.3-20 gts., in Sy.No.44/P. The husband of the petitioner died on 04.01.2021 leaving her as legal heir of the subject property, and later the petitioner has submitted online application before the respondent authorities requesting to mutate her name and issued e-pattadar passbooks in her favour. Challenging the proceedings dated 13.06.2020, respondent No.8 filed W.P.No.23579 of 2024 before this Court and the said writ petition was disposed of on 24.09.2024 directing the authorities to consider the online application submitted by the petitioner herein and pass orders by putting notice to all the interested parties. In terms of the said directions, respondent No.2-District Collector, issued letter dated 29.08.2025 to the District Registrar, Ranga Reddy District, directing to conduct enquiry into the registered sale deed dated 23.06.1977 and submit a report. While so, respondent No.8 submitted an application dated 06.10.2025 before the authorities requesting for conducting demarcation over the subject property, and acting on the said application, respondent No.6 issued notice dated 11.10.2025 for conducting demarcation on 17.10.2025.

Aggrieved by the same, this writ petition is filed.

4. Learned counsel for the petitioner submitted that the District Registrar has no right or jurisdiction to decide the title belongs to the petitioner unless the competent civil Court decides the matter.

5. Learned Assistant Government Pleader for Revenue submitted that this Court on 15.10.2025 granted status quo of all further proceedings in File No.A3/2520/2025, dated 11.10.2025. Since the said interim order is in operation, the respondent authorities have not taken any steps for conducting demarcation over the subject property. It is further submitted that as the date (17.10.2025) for conducting demarcation over the subject property has expired, the cause in the writ petition does not survive for adjudication.

6. In view of the above submissions, this writ petition is dismissed as infructuous. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
