WRIT PETITION No.34717 of 2025

ORDER

Heard learned counsel for the petitioner and learned

Assistant Government Pleader for Home appearing for respondent Nos.1 to 5. With their consent this writ petition is taken up for disposal at the admission stage itself. Notice to

respondent Nos.6 to 8 is hereby dispensed with.

2. This writ petition is filed seeking following prayer:-

“…to issue an appropriate writ or order or

direction, more particularly one in the nature of writ of mandamus, declaring the inaction of respondent police authorities in not taking any action on the complaint dated 18.10.2025 submitted by the petitioner, as illegal, arbitrary, improper, and violative of Articles 14, 21 and 300-A of the Constitution of India, and consequently to direct the respondent police to register an FIR forthwith based on the petitioner’s complaint dated 18.01.2025 under appropriate penal provisions; and direct the respondents not to interfere in any manner with the petitioner’s civil disputes or lawful possession over her property and pass such other order or orders as this Hon’ble Court deems fit and proper under the circumstances of the case and in the

interest of justice …”

3. The brief facts of the case as stated are that the petitioner is absolute owner and possessor of the house bearing H.No.12- 19-68/1 an extent of 55.00 Sq. yards or 45.98 Sq. Meters in Survey No.908, Raghavendra Colony, Kukatpally Village and Mandal, under GHMC Kukatpally Circle, Medchal-Malkajgiri District, Telangana (herein after ‘subject property’) which was purchased from one Jasoda Ramawat through registered agreement of sale with possession dated 14.12.2024. It is further stated that petitioner was in peaceful possession and enjoyment of the said property without any interference from any person. Thereafter, respondent Nos.6 to 8 with an ulterior motive to grab petitioner property unlawfully, started interfering with petitioner’s possession by bringing antisocial elements and henchmen. It is further stated that on 18.10.2025, they trespassed into petitioner’s premises, abused petitioner with filthy language and threatened petitioner with dire consequences. Subsequently, petitioner lodged a detailed written complaint on 18.10.2025 on the file of respondent No.5 seeking protection and registration of a case. Instead of taking action, respondent No.5 called petitioner to police station to settle the matter. Questioning the same this writ petition is filed.

4. On 17.11.2025, this Court granted time to learned Assistant Government Pleader to get instructions.

5. Today, when the matter is taken up for hearing no instructions are forth coming.

6. The main grievance of the petitioner is that the respondent police authorities are not taking any action on the complaint dated 18.10.2025 submitted by the petitioner and seeks direction to respondent police authorities to register an FIR forthwith based on the petitioners complaint dated 18.10.2025 under appropriate penal provisions and direct the respondents not to interfere in any manner with the petitioners civil disputes or lawful possession over her property.

7. Learned Assistant Government Pleader prayed this Court to pass appropriate orders.

Recording the submissions made by learned counsel appearing on either side, this writ petition is disposed of directing the respondent authorities to take appropriate action on the complaint of the petitioner dated 18.10.2025 by following due procedure contemplated under law and shall not interfere in civil disputes between petitioner and respondent Nos.6 to 8. As regards to the grievance against unofficial respondent Nos.6 to 8, the petitioner may seek appropriate remedy as available under law. It is also made clear that this Court is not expressing any opinion on the title and possession of the subject property.

9. With the above directions, this writ petition is disposed of. Miscellaneous applications, if any pending, shall stand closed.
