Writ Petition No.26963 of 2025

This writ petition is filed seeking following prayer:

“...declaring the inaction of the Official

Respondent Nos.2 to 5 in providing the police protection to the Petitioner agricultural lands pursuant to the representation dated 13.03.2024 pursuant to the Injunction Order dated 28.10.2022 in I.A.No.1179/2022 in O.S.No.402/2022 passed by the I Additional Junior Civil Judge, Vikarabad I/c Junior Civil Judge, Pargi, Vikarabad District restraining the Respondents Nos.10 to 15 herein and others from interlerina with the peaceful possession of the petitioner to an extent of Ac.1-00 gts., in Sy.No.297/EE/1/2, Madaram village, Pargi Mandal, Vikarabad District and burying the dead bodies in the Petitioners agricultural land is void abinitio and against to the Articles 14, 21 and 300A of the Constitution of India and consequently allow the Writ petition by directing respondent Nos.2 to 5 to provide the police protection to the petitioner agricultural land to an extent of Ac.1-00 gts., in Sy.No.297/EE/1/2, Madaram village, Pargi Mandal, Vikarabad District (subject land) from interference of the

Respondents Nos.10-15 herein and others...”

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 to 5; learned Assistant Government Pleader for Revenue appearing on behalf of respondent Nos.6 to 8 and Mr.K.Pradeep Kumar Reddy, learned standing counsel for respondent No.9. With their consent, this writ petition is taken up for disposal. Notice to respondent Nos.10 to 15 is dispensed with.

3. The facts of the case in brief as stated are that petitioner claims to be owner of subject land purchased vide registered sale deed No.2503/2022 dated 19.09.2022. It is submitted that respondent Nos.10 to 14 are trying to interfere into the petitioners possession, as such petitioner filed a suit in O.S.No.402 of 2022 on the file of Junior Civil Judge, Pargi, Vikarabad District. The trial Court granted interim injunction vide order dated 28.10.2022 in I.A.No.1179/2022 restraining respondent Nos.10 to 14 from interfering into the petitioner’s possession. In violation of Court orders, the unofficial respondents are burying dead bodies in the petitioner’s subject land. The Panchayat Secretary also failed to take any steps against unofficial respondents. In this regard, petitioner made a representation to Sub-Inspector of Police on 13.03.2024 and another representation to District Collector, Vikarabad on 10.06.2024. However, respondent authorities failed to consider representation of the petitioner and also did not provide any police protection for implementation of orders of trial Court in I.A.No.1179/2022. Questioning the same, the present writ petition is filed.

When the matter is taken up for hearing, after arguing for sometime, learned counsel for the petitioner submits that petitioner would seek appropriate remedies in the pending civil suit in O.S.No.402/2022 on the file of Addl.Junior Civil Judge, Vikarabad cum Junior Civil Judge, Parigi, Vikarabad, wherein an order of interim injunction is already in favour of petitioner and pray this Court to pass appropriate orders to that effect.

5. In that view of the matter, this writ petition is disposed of with liberty to the petitioner to seek appropriate remedy as available under law.

Miscellaneous petitions, pending, if any, shall stand closed. However, there shall be no order as to costs.
