THE HON’BLE SRI JUSTICE C.V.BHASKAR REDDY

ORDER:

This writ petition is filed seeking following relief:

“For the reasons stated in the accompanying Affidavit, It is therefore prayed that

this Hon’ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS, declaring inaction of Respondents No: 2 to 4 in not correcting revenue records from the name of Mohd Azam to Mohd Waised Ali, in respect of land in Sy No. 109 to an extent of Ac 0.31 Gts. land in Sy No. 113 to an extent of Ac 11.31 Gts and land in Sy No. 145 to an extent of Ac 0.14 Gts situated at Andavelli Village, Kaghaznagar Mandal, Kumarambhm Asifabad District, in pursuance to Petitioner’s Application dated 12.08.2024 submitted before Respondent No. 2 and Memo vide Rc No.B/227/2024 dated 16.10.2024 issued by Respondent No. 4, is being as illegal, unjust, arbitrary, against to the principles of natural justice and against to Article 300-A of Constitution of India and consequently, direct the Respondent No.2 to consider my representation dated 12.08.2024 to record names of legal heirs of pattadar Mohd Wajeed Ali in online Dharani Portal and issue E-Patta Pass book in respect of land in Sy No. 109 to an extent of Ac 0.31 Gts. land in Sy No. 113 to an extent of Ac 11.31 Gts and land in Sy No. 145 to an extent of Ac 0.14 Gts situated at Andavelli Village, Kaghaznagar Mandal, Kumaram bheem Asifabad District, pending before his authority and pass any such other order or orders which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case

in the interest of justice.”

2. It is stated that the petitioner along with other family members

are descendants of late Sri Mohd. Wajeed Ali, who was the owner and possessor of land admeasuring to an extent of Acs. 0.31 guntas in Survey No.109, Acs. 11.31 guntas in Survey No.113, Acs. 0.14 guntas in Survey No.145, totally admeasuring Acs. 12.46 guntas (for short, ‘the subject lands’), situated at Andavelli Village, Kaghaznagar Mandal, Kumarambheem Asifabad District and the petitioner’s family is in peaceful possession and enjoyment of the subject lands and the petitioner’s grandfather’s name was also reflected in the pahanies till the year 2004-05. It is further stated that

when the petitioner and other family members intended to partition the subject lands, the petitioner, on verifying the revenue records, found that the name of Mohd. Azam was erroneously recorded in the revenue records instead of Mohd. Wajeed Ali, without issuing any notice or opportunity to the petitioner. It is further stated that the petitioner’s father Sri Akhtar Ali made a representation dated 07.10.2024 to respondent Nos.2 and 4, wherein the 4^th respondent has issued the impugned memo dated 16.10.2024 stating that there are no provisions for cancellation of the patta at present and directed the petitioner’s father to approach the Court. The grievance of the petitioner is that due to the entry of wrong name in the revenue records, though the petitioner’s family is enjoying the subject lands, they are not in a position to receive the various incentives sanctioned by the Government for cultivation of the subject lands. Hence, the present writ petition.

3. Considered the submissions made by learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is disposed of at the admission stage.

4. A careful reading of the impugned Memo dated 16.10.2024 issued by the 4th respondent would reveal that the subject lands were registered in the name of Sri Wajid Ali’s father Mahibub Ali from the years 1983-84 to 1993-94 and on examining the current land register, the subject lands are in the name of Sri Mohammed Hazam’s father and therefore, there are no provisions for cancellation of the patta at present and directed the petitioner’s father to approach the Court.
