ORDER:

Heard Smt. K. Rajya Lakshmi, learned counsel appearing on behalf of the petitioner and learned Assistant Government Pleader for Services-I , appearing on behalf of respondent Nos.1 to 4.

The petitioner filed the writ petition seeking the following relief “… to issue a writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 4th respondent in passing the Speaking Orders No.EC2/R&B/WGL/2021-22/457 dated 12.10.2021 without considering the judgment in W.P.No.27217 of 2017 dated 19.09.2017 which was confirmed in SLP No.15327 of 2018 dated 07.05.2018 as illegal, arbitrary, violative of principles of natural justice by setting aside the same and consequently direct the respondents to regularize petitioner services in the cadre of Work Inspector with effect from his eligibility with all consequential benefits on par with similarly situated persons, and pass...”.

The case of the petitioner, in brief, is that the petitioner was appointed as NMR Work Inspector in 1985 and completed 5 years of service in 1990 with small breaks in services and though the petitioner had completed 13 years of service, but however, petitioner’s services had not been regularized. The petitioner filed O.A. No. 6638 of 1997 before the Tribunal and the same was disposed of directing the respondent to consider the case of the petitioner in terms of G.O.Ms.No.212 Finance Planning Department dated 22.04.1994 but the same was rejected on the ground that the petitioner had not completed 5 years of service as on 25.11.1993. Challenging the same, the petitioner filed O.A. No.4031 of 1998 and the same was dismissed on 18.09.2009. Later the petitioner filed I.D. No.7 of 2014 before the Industrial Tribunal at Warangal and the same was also dismissed on 17.01.2017.

3 (i). It is the further case of the petitioner that the petitioner completed Diploma in Civil Engineering. The petitioner relied on the judgment of this Court passed in W.P. No.27217 of 2017 dated 19.07.2017 wherein this Court directed the respondents therein to consider regularization of the services of the petitioner as Work Inspector against the existing vacancies.

On an earlier occasion the petitioner filed W.P. No. 1905 of 2021 before this Court and the same was disposed of on 13.07.2021 directing the respondents to consider the representation of the petitioner but the respondents rejected the request of the petitioner. Aggrieved by the same, the petitioner approached this Court by filing the present writ petition.
