This writ petition is filed seeking following prayer:-

“to pass an Order or Direction, more particularly one in the nature of Writ of

Mandamus, declaring the acts of the Respondent No.3 in obstructing and

threatening to stop the petitioner from digging an agricultural well despite

having valid permission dated 16-12-2025 vide RC.No.B/724/2025 in favour

of the petitioner in his patta land admeasuring Ac.4- 13 guntas in Survey

No.227 situated at Dubyala Village, Tekumatla Mandal, Jayashankar

Bhupalpally district, thereby preventing the petitioner to deal with it as

illegal, arbitrary, high-handed, without jurisdiction, violative of Articles 14,

19, 21 and 300-A of the Constitution of India, and contrary to the principles

of natural justice, consequently direct Respondents not to interfere with or

obstruct the petitioner from digging and completing the agricultural well in

his said land, allow the petitioner to proceed with the work to dig and

complete the well in the said land without any obstruction from any

authority, thereby allowing the petitioner to deal with his property,.”

2. Heard Mr. Shyam S. Agarwal, learned counsel for the petitioner;

learned Assistant Government Pleader for Home appearing for respondent

Nos.1 to 3; and learned Assistant Government Pleader for Home appearing

for respondent No.4. With their consent, this writ petition is being taken up

for disposal today.

3. Sri R.Laxmikanth Reddy, learned Assistant Government Pleader for

Home appearing for respondent Nos.1 to 3 placed instructions of Sub-

Inspector of Police, Tekumatla Police Station, wherein it is stated that one K.

Swami Rao lodged a complaint before respondent No.3-SHO, Tekumatla

Police Station, on 15.12.2025, stating that he is having land in the Dubyala

Village and a well on the side of the road, and the petitioner is digging new

well without the complainant's knowledge, with the help of JCB. After

completion of inquiry, respondent No.3 suggested the complainant to

approach the competent forum/authority for redressal and closed the said

complaint as Civil in Nature on 20.12.2025, and the same has been informed to

the complainant through Petition Management System (PMS). Thereafter,

respondent No.3 received a dial 100 call from one Sri Ramana Kumar on

20.12.2025 and upon receipt of the said call, concern staff visited the spot and

revealed that the dispute is civil in nature, and suggested to approach the

competent forum/authority for redressal.

4. Sri H. Rakesh Kumar, learned Assistant Government Pleader for

Revenue appearing for respondent No.4 submits that the petitioner was

granted permission by respondent No.4-Tahsildar, Tekumatla Mandal, in

accordance with Rules 12 and 14 of the WALTA Act.

5. In that view of the matter, since the petitioner has obtained permission

from respondent No.4 and since the police have closed the complaint as civil in

nature after enquiry, this writ petition is disposed of directing the police to

follow due process of law before initiating any action on the petitioner and on

the subject land.

6. Miscellaneous applications, if any pending, shall stand closed. No order

as to costs.
