This writ petition is filed seeking the following relief:

“….to issue appropriate writ or order or orders and more particularly in the nature of writ of mandamus declaring that the acts, deeds and things of the 1^st respondent without giving any notice or hearing me and passing ejectment orders in LTR Case No.32/07/CHG dated 1.12.2007 and interfering with my land in respect of the agricultural dry land admeasuring acres 2-36 guntas in Sy.No.85 situated at Tungaram village, Chandrugonda Mandal, Khammam District are illegal, malafide, arbitrary, violative of principles of natural justice and much against to the legal and fundamental rights guaranteed under the constitution of India and consequently set aside the same and direct the respondents not to interfere with the peaceful possession and enjoyment of the agricultural dry land admeasuring acres 2-36 guntas in Sy.No.85 situated at Tungaram village, Chandrugonda Mandal, Khammam

District.…”

2. Heard Sri Palivela Satyraja Babu, learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing

for respondent No.1. Perused the record.

It is stated that the petitioner has purchased agricultural land admeasuring Acs.2-36 guntas in Sy.No.85, situated at Tungaram Village, Chandrugonda Mandal, Khammam District, by way of registered Sale Deed bearing document No. 594 of 1967, and since then she is in possession and enjoyment of the same. It is stated that the Special Deputy Collector, Tribal Welfare, Paloncha, Khammam District had initiated LTR Case No. 343 of 1988 alleging that the petitioner purchased the above land contrary to the A.P. Scheduled Areas Land Transfer Regulation 1959 Read with Regulation I of 1970. While so, on the basis of the alleged report dated: 24-05-2007 submitted by the Tahsildar, Chandrugonda Mandal, respondent No.1-Agency Divisional Officer, Kothagudem, Khammam District, initiated proceedings under A.P. Scheduled Areas Land Transfer Regulation under LTR Case No.32/07/CHG against Smt. Poojala Laxmamma alleging that a transfer of the immovable property has taken place contrary to the above Regulation, wherein the said order discloses that the petitioner has sold the subject land. Respondent No.1 had also passed eviction orders in LTR Case No.32/07/CHG, dated 01.12.2007, without providing an opportunity of hearing to the petitioner before initiating said proceedings, therefore prays for a direction to set aside the said orders.

4. Learned Government Pleader for Social Welfare submits that if the petitioner is aggrieved by the eviction orders, an appeal lies to the Agent to Government, i.e., District Collector, Khammam.

5. In view of the above, this writ petition is disposed of permitting the petitioner to file an appeal before the Agent to Government, i.e., District Collector, Khammam, within a period of four weeks from the date of receipt of a copy of this order. Till the disposal of the said appeal, the interim order granted by this Court stands continued. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
