Heard Sri G. Rajeshwar Reddy, learned counsel for

the petitioner and Smt S. Sravanthi, learned Assistant Government Pleader for Stamps and Registration for the

respondents.

Learned Counsel for the petitioner submits that the petitioner is questioning the action of the respondent No.3 in refusing to register the three General Power of Attorney all dated 21.11.2025 presented by the petitioner in respect of (1) Semi finished Flat No.401,Fourth Floor in the building known as RS Residences having plinth area of

1650 sft including common area and car parking along with undivided share of land admeasuring 50.05 sq. yds out of land admeasuring 533.66 sq. yds (2) Semi finished Flat No.402, Fourth Floor in the building known as RS Residences having plinth area of 1700 sft including common area and car parking along with undivided share of land admeasuring 52 sq. yds out of land admeasuring 533.66 sq. yds and (3) Semi finished Flat No.502, Fifth Floor in the building known as RS Residences having plinth area of 1650 sft including common area and car parking along with undivided share of land admeasuring 50.5 sq. yds out of land admeasuring 533.66 sq. yds all are constructed on Plot Nos.16 and 17 in Sy.Nos.178/P to 183, 188, 189, 190/P, 193 to 196 in Block No.5 situated at Gajularamaram Village, Quthubullapur Mandal, Medchal- Malkajgiri District belongs to petitioner’s husband namely Reddy Praveen Reddy on the ground that he is in Central Prison, Cherlapally and without his participation he cannot execute the same as illegal and arbitrary and to direct the respondent No.3 to receive and register the said General Power of Attorneys all dated 21.11.2025 as per the applicable legal provisions by obtaining the signatures of the husband of petitioner at Jail premises before the respondent No.4.

Learned Assistant Government Pleader for Stamps and Registration submits that the petitioner has not made application under Section 38 of the Registration Act, 1908 and also Chapter-X Rules 41 to 48 of Telangana Rules under the Registration Act, 1908 and she has to make application as per the Standing Order 661 of Stamps and Registration Manual, and if the petitioner makes appropriate application, the respondent authorities have to consider the same by following due procedure as per law.

In view of the aforesaid submissions, the Writ Petition is disposed of granting liberty to the petitioner to make application as per Section 38 of the Registration Act,1908 and also Rules 41 to 48 of Chapter-X of Telangana Rules under the Registration Act, 1908 and on receipt of the said application, the respondent authorities are directed to consider the said application after following due procedure and register the said document presented by the petitioner and more particularly the respondent No.2 is directed to take steps to give date and time for registration of the documents.

The respondent No.4 is directed to give appropriate permission to take signatures of the husband of the petitioner to enable the petitioner to register the subject documents. There shall be no order as to costs.

5. Miscellaneous Petitions, if any pending in this writ petition, shall stand dismissed. No order as to costs.
