ORDER
This writ petition is filed seeking the following relief:
“...pleased to issue an order or direction more particularly one in the nature of Writ of MANDAMUS by declaring the action of the respondent No.3 issued the proceedings vide Rc.No.A/52/2019, dt.20.05.2025 denying the compensation to the petitioner for acquired the land in Sy.No. 74/6, an extent of Ac.0.11 gts, in Sy.No.76/13 an extent of Ac.0.02 gts, in Sy.No. 78/32 an extent of Ac.0.14 gts, in Sy.No. 78/26 an extent of Ac.0.02 gts, in Sy.No.78/29 an extent of Ac.0.27 gts and in Sy.No. 80/10 an extent Ac.0.06 gts, total an extent of Ac.1-22 gts situated at Yathakula Kunta Village, Sathupally Mandal, Khammam District on the ground that, after disposal of the civil suit compensation will be paid basing on the court orders though the petitioner is not party in the said suit vide O.S.No.33/2025 on the file Agent to the Government, Khammam is illegal, arbitrary and violation of principles of natural justice and Consequently direct
the respondent No.3 to pay the compensation as per the award dt.19.03.2021 and pass...”
2. Heard Mr. K.Venkataramanaiah, learned counsel for the petitioner and learned Assistant Government Pleader for Land Acquisition appearing for respondent Nos.1 to 4. Perused the material available on record.

The brief facts of the case as stated are that the petitioner has purchased the land admeasuring Ac.0.11 guntas, in Survey No.74/6, Ac.0.02 guntas in Survey No.76/13, Ac.0.14 guntas in Survey No.78/32, Ac.0.02 guntas in Survey No.78/26, Ac.0.27 guntas in Survey No.78/29 and Ac.0.06 guntas in Survey No.80/10, total an extent of land Ac.1.22 guntas, situated at Yathakula Kunta Village, from Sri Thati Sathyam, having purchased the same through Sada Sale Deed and has been in peaceful possession over the subject property. The said land was acquired in 2019 for the Seetharama Project Canal. It is the case of the petitioner that though he has purchased the said lands, the respondent authorities have paid the compensation in his vendor’s name, as his name was not mutated in the revenue records. Therefore, the petitioner has submitted a representation, dated 19.03.2025, seeking disbursement of compensation to him. As no action was taken, he filed W.P.No.12785 of 2025, which was disposed of on 25.04.2025, directing the respondent authorities to consider the said representation. Thereafter, the respondent authorities issued the impugned proceedings vide Rc.No.A/52/2019, dated 20.05.2025, rejecting the petitioner’s claim on the ground that a money recovery suit vide O.S. No.33 of 2025, was filed by respondent No.5 against the petitioner’s vendor. It is submitted that the petitioner’s vendor himself has furnished a No Objection Certificate, dated 02.05.2025, consenting payment of compensation to the petitioner, but without proper verification respondent No.3 has issued impugned proceedings, which is in violation of principles of natural justice, and contrary to the provisions of the Land Acquisition Act. Aggrieved by the same, this present writ petition is filed.

Learned counsel for the petitioner submits that at the time of filing of this writ petition, a suit i.e., O.S.No.33 of 2025, filed by respondent No.5 was pending on the file of the Agent to Government, Khammam and further submits that the said suit was disposed of on 19.09.2025. Learned counsel for the petitioner further submits that since the suit has already been disposed of, the petitioner will make a representation before respondent No.3 enclosing the copy of an order in O.S.No.33 of 2025, dated
19.09.2025.
