O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India

seeking the following relief/s:-

“to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the 3^rd respondent in appointing Sri D.Narasimha, Senior Advocate for conducting the prosecution as Special Public Prosecutor in relation to S.C.No.96 of 2018 on the file of the Special Sessions Judge for Trial of SCs/STs (POA) Act cases at Nalgonda in spite of the written representation dated 05.07.2018 followed by repeated personal visits as illegal, arbitrary and unjust and to consequently direct the 3^rd respondent herein to appoint the said Advocate as Special Public Prosecutor pursuant to the representation dated 05.07.2018 as per the provisions of SCs/STs (POA) Act and the

Rules made there under and pass…”

2. None appeared on behalf of the petitioner.

3. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home, appearing for respondent Nos. 1 and 2.

4. Learned Assistant Government Pleader for Home submits that S.C. No.96 of 2018 was duly tried before the Court of the Special Sessions Judge for Trial of Cases under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, and II Additional Sessions Judge, Nalgonda, and that the said Sessions Case culminated in an acquittal by judgment dated 05.07.2024. Accordingly, the contention of the petitioner seeking appointment of a Special Public Prosecutor for conducting the prosecution no longer survives for consideration and is rendered infructuous.

The grievance of the petitioner is that, pursuant to his representation dated 05.07.2018, he sought a direction to the respondent police authorities to appoint a Senior Advocate as Special Public Prosecutor to conduct the prosecution in the said Sessions Case. However, the subsequent development, namely, the conclusion of the trial in S.C. No.96 of 2018 and the pronouncement of judgment therein, clearly demonstrates that the cause of action raised in this writ petition no longer survives for adjudication. In the circumstances, as the underlying proceedings have already attained finality, no further directions are warranted.

6. Accordingly, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed.
