O R D E R :

With the consent of both parties, this Writ Petition is taken

up for disposal at the admission stage itself.

2. This Writ Petition is filed under Article 226 of the

Constitution of India, seeking the following relief:

“…to issue writ order or direction more particularly one in the

nature of writ of ‘Mandamus’ declaring the action of the respondents in not sanctioning the Pension & Pensionary benefits to the petitioner who was retired from service on 30-04-2025 AN as illegal, arbitrary, unjust, unreasonable, contrary to law and against principles of natural justice and consequently direct the respondents to sanction

Pension & Pensionary benefits to the petitioner immediately duly considering the representation of the petitioner dated 25-08-2025 in the interest of justice and to pass…”

3. Heard Sri D.Rama Krishna, learned counsel for the petitioner and learned Government Pleader for Services-I for the respondents. 4. Learned counsel for the petitioner submits that the petitioner was appointed as a Full-Time Contingent Night Watchman on 26.06.1991 and, after rendering 34 years of continuous service, he was retired from service on 30.04.2025. As such, the petitioner submitted a representation to respondent No.3 on 25.08.2025 requesting for grant of pension and other pensionary benefits for the 34 years of service rendered by him. However, no action has been taken by respondent No.3 so far. Therefore, learned counsel prays this Court to direct respondent No.3 to consider the representation dated 25.08.2025 submitted by the petitioner and pass appropriate orders within a time-frame to be stipulated by this Court.

5. Learned Government Pleader appearing for the respondents submits that the petitioner was not a regular employee and therefore, he is not entitled to pension or pensionary benefits.

However, since the representation dated 25.08.2025 is pending consideration, respondent No.3 will pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of, directing respondent No.3 to pass appropriate orders on the representation dated 25.08.2025 submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate a copy of the decision to the petitioner.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
