WP 36950/2025

IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD

THE HONOURABLE SRI JUSTICE N.TUKARAMJI

WRIT PETITION No.36950 OF 2025

DATE : 03.12.2025

Between:

Yalamarthy Venkateswar Rao …Petitioner

AND

The State of Telangana & Others

…Respondents

ORDER:

This Writ Petition is filed under Article 226 of Constitution of

India seeking the following relief:

“…to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent no.3 in frequently summoning the petitioner to the police station without any valid reason, as being illegal, arbitrary, violation of principles of natural justice, contrary to the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and violation of Article 14, 19 and 21 of the Constitution of India and consequently direct the

respondents to follow due process of law and pass......”

2. Heard Mr. Ch.Satya Sadhan, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government

Pleader for Home appearing for respondents.

3. Learned counsel for the petitioner submits that respondent No. 3, without any lawful cause, has been summoning the petitioner to the police station, thereby causing inconvenience and interfering with his personal life and liberty. Aggrieved thereby, the petitioner has filed the present writ petition seeking necessary directions to the concerned police authorities.

4.1. Learned Assistant Government Pleader for Home submits that the petitioner is arrayed as an accused in Crime No. 36 of 2024. During the course of investigation, the petitioner was called for examination. It is contended that the allegations that the respondent police authorities are interfering with the petitioner’s personal life and liberty, or unnecessarily summoning him to the police station, are without any basis.

4.2. He further submits that the respondent police authorities are conducting the investigation strictly within the parameters of law. Hence, the allegations made by the petitioner are unfounded, and the writ petition is liable to be dismissed.

5. I have perused the material placed on record.

6. The petitioner, in his affidavit, has alleged that respondent No. 3 has been frequently summoning him to the police station without any valid reason. The respondents, through the learned Assistant Government Pleader, have explained that the petitioner’s presence was required in connection with the pending crime.

7. However, having regard to the pleadings, the submissions made, and the limitations of the police authorities even during the course of investigation, this Court deems it appropriate to direct respondent No. 3 to refrain from summoning the petitioner to the police station without any lawful or tenable ground and from interfering with his personal life and liberty, except in strict accordance with law and by following due process.

8. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
