O R D E R:

This Writ Petition is filed under Article 226 of the

Constitution of India seeking the following relief:

“…To issueWrit or direction preferably Writ of Mandamus, declaring the action of the respondent No.5 in preparing a false 161 Cr.P.C. statement of wife of the petitioner in Cr. No.165/2018 on the file of P.S. Sadasivapet, Sanga Reddy District and also the action of respondent No.3 in not taking any action against the respondent No.5 and in not taking any steps for reinvestigation in Cr. No.165/2018 on the file of P.S. Sadasivapet, Sanga Reddy District on the representation of the petitioner dated 03.12.2018 as arbitrary, illegal and violative of Articles 14, 19(i)(g) and 21 of the Constitution of India and consequently direct the respondent No.3 to take appropriate action for

reinvestigation in Cr. No.165/2018 on the file of P.S. Sadasivapet and also to take appropriate action against the respondent No.5 on the representation made by the petitioner dated

03.12.2018 …………..…”

2. None appeared on behalf of the petitioner.

Learned Assistant Government Pleader for Home submits that the petitioner, while contesting the investigation in Crime No. 165 of 2018 of Sadasivpet Police Station, sought reinvestigation of the said crime. However, it is submitted that the case was duly investigated, and upon completion of investigation, a charge sheet was filed. The case was taken on file as C.C. No. 508 of 2018 before the Special Mobile Court, Sangareddy. After due trial, the accused was convicted by judgment dated 07.07.2018 and sentenced to pay a fine of Rs. 1,000/-. In view of the said conviction, the contention raised by the petitioner does not survive for adjudication.

4. I have perused the material placed on record.

5. The grievance of the petitioner is that respondent No. 3 failed to take action against the unofficial respondent in Crime No. 165 of 2018. However, as reported by the learned Assistant Government Pleader, the investigation culminated in the filing of a charge sheet, and the case was duly tried, resulting in conviction of the accused. In view of these developments, it is evident that the grievance of the petitioner has been effectively addressed by the respondent police. Therefore, nothing further remains in this matter for consideration.

6. Accordingly, the Writ Petition is dismissed as infructuous.

There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
