WP 36818/2025

IN THE HIGH COURT FOR THE STATE OF TELANGANA AT

HYDERABAD

THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL

WRIT PETITION No.36818 of 2025

DATE OF ORDER: 02.12.2025

Between:

S.Saraswathi

...Petitioner

AND

The State of Telangana, rep. by its

Principal Secretary,

Revenue Department Telangana,

Secretariat, Hyderabad and three others

...Respondents

ORDER:

Aggrieved by the endorsement issued by respondent No.3

bearing endorsement No.1/2862/2025, dated 06.09.2025, the present writ petition is filed. A consequential prayer is sought to direct respondent No.3 to set aside the said endorsement and issue a Family Member Certificate incorporating the names of the petitioner and her

daughters.

2. Heard learned counsel for the petitioner and Mr. L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 3.

3. Learned counsel for the petitioner submitted that the petitioner is the legally wedded wife of the deceased one Sri K.Srinivasulu. It is further submitted that the petitioner’s husband worked as a Government Servant. The petitioner’s husband expired on 19.03.2025 leaving behind the petitioner and her two daughters. Upon sudden demise of the petitioner’s husband, the petitioner made an online application bearing No.FAMC022501836419, dated 19.08.2025 along with relevant document. Without considering the application made by the petitioner herein and on the false claim made by the other, stated to be the second wife of the deceased husband of the petitioner, no action has been taken on the petitioner’s application and issued the impugned endorsement stating that “since there was a dispute between the two wives, it is not possible to issue a family member certificate” and got rejected the petitioner’s application. It is further submitted that Family Member Certificate has been issued in respect of retired Government Servant only to claim the benefits, if any, subsequent to their demise and nothing beyond it. It is under these circumstances, the official respondents ought to have examined the Service Register of the petitioner’s husband and without going into that aspect, issued the impugned endorsement. Since the case of the petitioner has not been consider, learned counsel for the petitioner sought the liberty of this Court to take necessary steps in accordance with law before an appropriate forum against the unofficial respondent and seeks to pass appropriate orders.

4. Learned Assistant Government Pleader for Revenue submitted that a memo has been issued by the official respondent No.1 vide Memo No.11496/Ser.II(2)/2013-14, dated 25.06.2013 and stated that the Family Member Certificate shall not be issued in disputed cases of civil nature, ex: cases of multiple wives, etc.,. By taking into consideration the said aspect, the respondent No.3 had issued the impugned endorsement.

5. This Court, having heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue and on perusing the memo issued by the official respondents at precaution No.5 that a Family Member Certificate cannot be issued in case of a civil dispute i.e. in case of multiple wives, and without making any observations on merits and demerits of the case, deems it appropriate to grant liberty to approach the Civil Court to work out her remedies strictly in accordance with law, where the petitioner shall make the unofficial respondent No.5 also as a party.

6. With the above directions, this writ petition is disposed of at the admission stage with consent of learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, granting liberty to the petitioner, as stated supra. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications if any pending, in this petition, shall stand closed.
