O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of

India seeking the following relief:

“…to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus directing the respondent Nos. 4 and 5 to investigate the Crime No. 753 of 2018 clubbing together with Crime No. 114 of 2018 transferring either to the respondent No. 4 P.S. or respondent No. 5 Police Station for joint investigation to avoid the deprive the justice on wrong conclusion

in the interest of justice and pass such other order or orders…”

2. None appeared on behalf of the petitioner.

3. Mr. D. Pradeep, learned Assistant Government Pleader for Home, appearing for respondent Nos. 1 to 5, submits that Crime No. 753 of 2018 was registered on the file of Kukatpally Police Station, and after due investigation, a charge sheet was filed and the case was numbered as C.C. No. 988 of 2020 on the file of the learned VIII Additional Metropolitan Magistrate, Kukatpally. The same is presently pending trial. Likewise, Crime No. 114 of 2018 was registered on the file of the Central Crime Station, Hyderabad, and a charge sheet therein was filed before the learned XII Additional Chief Metropolitan Magistrate, Hyderabad, vide S.R. No. 13027 of 2020.

He further submits that, as the transactions involved in the two cases are distinct and have been investigated by different police stations having separate jurisdiction, the prayer for clubbing the two crimes and conducting a joint investigation does not arise. Accordingly, the learned Assistant Government Pleader prayed for dismissal of the writ petition.

5. I have perused the material on record.

6. The prayer of the petitioner is to direct a joint investigation by clubbing Crime No. 753 of 2018 of Kukatpally Police Station and Crime No. 114 of 2018 of the Central Crime Station, Hyderabad. However, the developments reported by the learned Assistant Government Pleader for Home clearly demonstrate that independent investigations were conducted in both crimes, and charge sheets have been filed during the pendency of this petition. Consequently, the prayer sought by the petitioner has become infructuous.

That apart, considering the submissions of the learned Assistant Government Pleader for Home that the crimes emanate from different jurisdictions and are already at an advanced stage before the respective Courts, this Court finds no justifiable ground to interfere, much less to direct a joint investigation.

8. For the aforesaid reasons, in the absence of any merit, this Writ Petition is dismissed. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
