WRIT PETITION No. 4027 OF 2017

ORDER:

This Writ Petition is filed with the following relief:

“…to issue a writ or order more particularly one in

the nature of writ of mandamus declaring the action of the respondents Nos. 2 to 5 in not providing police protection for construction of compound wall surrounded by petitioner Muth lands in survey No.242 (old), new survey Nos.338, 339, 340, 341, 342, 343 and 344 admeasuring Ac.16.32 guntas situated at Attapur village, Rajendrangar mandal, Rangareddy District inspite of the permission accorded by the Endowments Department, Telangana State vide proceedings RC.No.C/3088/2014 dated 08.01.2015 and also the petitioner representation dated 25.01.2017 and also not initiating any criminal action against the land grabbers namely i.e., 1) M.Sudhakar Reddy S/o.M.Dasarath Reddy, R/o.H.No.1-9-54, Huda Colony, Attapur, Rajendranagar, Rangareddy District and 2) Ram Reddy @ Gudumba Ramreddy S/o.Achireddy, Occ: TRS Party local leader, R/o.Attapur, Rajendranagar mandal, Rangareddy District and other associates of M.Sudhakar Reddy i.e., Pawan Kumar Sony, Arun Kumar Sony, Ghanshyam sony and also their associates as illegal, arbitrary, unjust and also against Article 300A of Constitution of India and consequential directions to the respondents to provide police protection to the petitioner Muth and its constructional activity of the construction of compound wall surrounded by the petitioner muth properties i.e., survey No.242 (old), new survey Nos.338, 339, 340, 341, 342, 343 and 344 admeasuring Ac.16.32 guntas situated at Attapur village, Rajendrangar mandal, Rangareddy District by restraining the following persons and their illegal activities i.e., 1) M.Sudhakar Reddy S/o.M.Dasarath Reddy, R/o.H.No.1-9-54, Huda Colony, Attapur, Rajendranagar, Rangareddy District and 2) Ram Reddy or Gudumba Ramreddy S/o.Achireddy, Occ- TRS Party local leader, R/o.Attapur, Rajendranagar mandal, Rangareddy District and other associates of M.Sudhakar Reddy i.e., Pawan Kumar Sony, Arun Kumar Sony, Ghanshyam sony and also their associates who are making illegal trials to grab the petitioner muth properties i.e., old Saibaba mandir locates in petitioner

muth lands for their illegal means forthwith and to pass…”

2. Heard Mr.V.Brahmaiah Chowdary, learned counsel for the petitioner, Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5.

3. Learned counsel for the petitioner submits that the petitioner has passed away and seeks time to obtain further instructions.

4. The learned Assistant Government Pleader for Home submits that, as per the instructions received from the Sub-Inspector of Police, Attapur, an enquiry was conducted with the petitioner’s son. It was stated that, during the petitioner’s lifetime, when he intended to construct a boundary wall, certain individuals had illegally interfered with the construction, leading to the filing of the present petition. However, the boundary wall and a gate have since been constructed, and there has been no further interference from those individuals thereafter.

Accordingly, there is no subsisting issue on the aspect raised in the petition. Hence, the learned Assistant Government Pleader for Home prays that the writ petition be dismissed.

5. I have perused the material available on record.

6. The written instructions filed by the learned Assistant Government Pleader for Home, along with the statement of Mr. Akash Deep Agarwal, the petitioner’s son, have been duly considered. Upon examination of the said statement and the record, it is evident that nothing further remains for adjudication in this matter, nor does the case warrant any further direction.

7. Accordingly, this petition is dismissed as infructuous.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
