WRIT PETITION No.32344 OF 2025

O R D E R :

With the consent of both parties, this Writ Petition is taken

up for disposal at the admission stage itself.

2. This Writ Petition is filed under Article 226 of the

Constitution of India, seeking the following relief:

“…to pass an order or direction or writ in the nature of Mandamus duly

declaring the action of the 3^rd respondent in not issuing the No Due certificate and not considering the representation dated 15.07.2025, for the petitioner to process his pension papers for approval, as illegal, arbitrary and against the principles of natural justice and consequently, direct the respondents to issue No Due Certificate duly considering the representation dated 15.07.2021, and to process the pension proposals of the petitioner

thereafter, in the interest of justice and to pass…”

3. Heard Sri P.Rama Sharana Sharma, learned counsel for the petitioner; learned Government Pleader for Services-I for respondent Nos.1 to 4; and Sri G.Sree Chandra, learned Standing Counsel for Samagra Shiksha Abhiyan, appearing for respondent

No.5.

4. Learned counsel for the petitioner submits that the petitioner had served as a Lecturer at respondent No.4-Institute, thereafter he held the post of District Educational Officer, Khammam, and

subsequently retired from service on 30.04.2025 upon attaining the age of superannuation. As such, the petitioner submitted his pension proposals for sanction of his pension to the Principal of respondent No.4, who is the concerned authority for forwarding the said proposals to the higher authority. However, respondent No.5 has to issue a No Objection Certificate, which is necessary for the approval of the pension proposals. As such, the petitioner submitted a representation to respondent No.5 on 15.07.2025 requesting issuance of a No Objection Certificate for forwarding the pension papers, and the same is pending consideration. Therefore, learned counsel prays this Court to direct respondent No.5 to consider the representation dated 15.07.2025 submitted by the petitioner and to issue the No Objection Certificate, within the time-

frame stipulated by this Court.

5. Learned Standing Counsel appearing for respondent No.5 submits that respondent No.5 will consider the petitioner’s representation dated 15.07.2025 and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of, directing respondent No.5 to take appropriate decision on the representation dated 15.07.2025 submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order and communicate a copy of the decision to the petitioner.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
