IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
SYED SADIQ MOHIUDDIN – Appellant
Versus
STATE OF TS – Respondent
WP 14939/2018

ORDER:

This Writ Petition is filed under Article 226 of the Constitution of

India seeking the following relief:

“…to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 3rd respondent in registering the complaint as FIR No.51 of 2018, on the file of the Central Crime Station, Hyderabad, without conducting investigation as contemplated under the Criminal Procedure Code and further declare the investigation being carried on by the 4th respondent as arbitrary, illegal, contrary to Criminal/ Procedure Code and violation of Articles 14 and 21 of Constitution of India and consequently direct the respondents to conduct the investigation as per the procedure contemplated under the Criminal Procedure Code without arresting the

petitioners and to pass…”

2. Heard Ms.Monica P Pole, learned counsel representing Mr.P.Subash, learned counsel for the petitioners and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for

respondents No.1 to 3.

3. Learned counsel for the petitioner submits that, challenging the action of respondent No.3 in registering Crime No.51 of 2018 without any legal basis, the present petition has been filed seeking quashment

of the FIR.

4. Learned Assistant Government Pleader for Home submits that Crime No.51 of 2018 was duly investigated by the police and that a

final report dated 25.07.2018, classifying the matter as “civil in nature,” was filed before the learned XII Additional Chief Metropolitan Magistrate, Hyderabad. Thus, the contention of the petitioner no longer survives for consideration.

5. I have perused the material available on record.

6. Having regard to the relief sought by the petitioner, the developments that have transpired during the pendency of this petition, and the fact that the respondents/police authorities have already filed the final report resulting in closure of the crime, this Court is of the considered view that nothing further remains for adjudication.

7. Accordingly, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
