ORDER:
Heard Sri G. Raman Goud, learned counsel appearing on behalf of petitioner and learned Assistant Government Pleader for Forests, appearing on behalf of respondents.
2. The petitioner approached the Court seeking prayer as under:
“…to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus to direct the respondents to consider and promote the petitioner to the post of Forest Section Officer for the panel year 2017-2018 as petitioner is fully eligible and qualified for promotion as per G.O.Ms.No.337, GA (Ser) Department dated 18.06.1983 and as per Rule 6 of Telangana State and Subordinate Service Rules and before promoting any other persons and pass...”.

The case of the petitioners, in brief, is that the petitioner joined as Forest Beat Officer during the year 2010 and completed nine years of service and qualified for promotion to the post of Forest Section Officer. The 4th respondent considered the Serial Nos.18 and 19 for promotion as Forest Section Officer, but did not consider the case of the petitioner, who is at Serial No.20, for promotion as Forest Section Officer in the panel year 2017-2018 though the petitioner is fully eligible and qualified for promotion as G.O.Ms.No.337, GA (Ser) Department dated 18.06.1983 and as per Rule 6 of Telangana State and Subordinate Service Rules. Aggrieved by the same, the petitioner approached the Court by filing the present writ petition.

Learned counsel appearing on behalf of the petitioner submits that the petitioner’s name is at Serial No.20 for promotion to the post of Forest Section Officer and fully eligible and qualified for promotion of the said post for the panel year 2017-2018 as per G.O.Ms.No.337, GA (Ser) Department dated 18.06.1983 and as per Rule 6 of Telangana State and Subordinate Rules and the case of the petitioner should be considered provided promoting any other persons. But however, the same had not been considered as on date, and therefore, the writ petition may be allowed as prayed for.

The learned Assistant Government Pleader for Forests, appearing on behalf of respondents submits that the writ petition could be disposed of directing the respondents to consider the request of the petitioner for promotion to the post of Forest Section Officer for the panel year 2017-2018 as per G.O.Ms.No.337, G.A. (Ser) Department dated 18.06.1983 and as per Rule 6 of Telangana State and Subordinate Service Rules in accordance to law, within a reasonable period.
6. Taking into consideration :
(a) The aforementioned facts and circumstances of the case, (b) The averments made in the counter affidavit filed on behalf of the respondents, (b) The submissions made by the learned Assistant Government Pleader for Forests, appearing on behalf of the respondents without going into the merits of the rival contentions put forth by the learned counsel appearing on behalf of the petitioner, The writ petition is disposed of directing the respondents to consider the request of the petitioner for promotion to the post of Forest Section Officer for the panel year 2017-2018 as per G.O.Ms. No.337, GA (Ser) Department, dated 16.06.1983 and as per Rule 6 of Telangana State and Subordinate Service Rules and pass appropriate reasoned orders in accordance to law, in conformity with principles of natural justice by providing an opportunity of personal hearing to the petitioner, within a period of four (4) weeks from the date of a copy of the order and duly communicate the decision to the petitioner. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any pending, in the Writ Petition shall also stand closed.
