IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE JUSTICE MOUSHUMI BHATTACHARYA,THE HONOURABLE SRI JUSTICE GADI PRAVEEN KUMAR
Jitender Kumar Gupta – Appellant
Versus
Mallepalli Jeevan Reddy – Respondent
WA 1133/2025
THE HON’BLE JUSTICE MOUSHUMI BHATTACHARYA AND THE HON’BLE JUSTICE GADI PRAVEEN KUMAR Mr. K. Rama Subba Rao, learned counsel appearing for the appellants. Mr. K. Ravi Kumar, learned counsel appearing for the respondent No.1.
ORDER:(Per Hon’ble Justice Moushumi Bhattacharya
1. The Writ Appeal arises out of an order passed by a learned Single Judge of this Court on 04.08.2025 in a Writ Petition (W.P.No.22851 of 2025) filed by the respondent No.1 against the action of the respondent Nos.3 and 4 for not registering the respondent No.1’s Sale Deed and not issuing pattadar passbook by entering the name of the respondent No.1 in the Revenue Records for the subject land despite having booked the slot vide Application No.2500032733 dated 04.03.2025 and having paid the challan vide No.REG2500030399.
2. By the impugned order, the learned Single Judge disposed of the Writ Petition by directing the Registering Authority to consider the respondent No.1’s application (Application No.2500032733) dated 04.03.2025 and register a Sale Deed and issue pattadar passbook by entering the name of the respondent No.1 in the Revenue Records for the subject land within four weeks from the date of receipt of copy of the said order, subject to the respondent No.1 complying with the provisions of The Registration Act, 1908 and The Indian Stamp Act, 1899. Learned Single Judge made it clear that the Registering Authority would be at liberty to refuse the document presented before itself in case it has any objection by duly assigning reasons in support of such decision and communicating the said decision to the respondent No.1. The impugned order also records that the Court has not expressed any opinion on the merits of the case pertaining to the entitlement of the respondent No.1 to get the subject document registered.
3. The appellants before us were not parties to the Writ Petition and claim to be the title holders of the subject land. Learned counsel appearing for the appellants submits that the appellants would be greatly prejudiced if the Registering Authority considers the respondent No.1’s application in the absence of the appellants.
4. All the parties are represented before us. We note that the right claimed by the appellants in respect of the subject land would be irrevocably prejudiced if the appellants are not given an opportunity for hearing before the Registering Authority.
5. It is evident from the record that the Registering Authority has not taken any steps till date pursuant to the impugned order. The time granted to the Registering Authority to pass the reasoned order has also expired.
6. We thus dispose of the Writ Appeal by directing the Registering Authority to also consider the case of the appellants before passing a reasoned order as directed by the learned Single Judge. Needless to say, the respondent No.1/Writ Petitioner shall also be heard by the Registering Authority. Hence, the Registering Authority shall pass a reasoned decision within three weeks from 24.10.2025. The Registering Authority shall give personal hearing to all the relevant parties.
7. W.A.No.1133 of 2025, along with all connected applications, is accordingly disposed of in terms of the above. There shall be no order as to costs.
