ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“...to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in continuing the petitioner herein under suspension since 2-2-2005 without passing any orders despite the petitioner submitting the explanation dated 1.6.2006 to the show cause notice dated 8.5.2006, as illegal, arbitrary and contrary to Bye-Law 12(3) r/w section 59(3) of the A.P.Cooperative Societies Act, and consequently declare that the Petitioner is entitled for reinstatement along with all backwages and other benefits and to grant such other relief or reliefs as this Hon’ble Court deem fit...”

2. When the matter is taken up for hearing, learned counsel for the petitioner submitted that in view of the interim orders granted by this Court on 12.09.2008, the petitioner was reinstated into service and also retired from service.

3. In the counter affidavit filed by respondent Nos.1 to 3, at para

7 it is stated as follows:-

“It is further submitted that the petitioner himself accepted the same vide his letter dated 05.02.2021 addressed to the 2nd respondent. He also submitted that he retired from the service and also received his retirement benefits. As such there is no circumstance or legal aspects pending to produce before this Hon’ble Court for further proceedings in the said case”.

4. Since the petitioner retired from service and also receied his retirement benefits, the writ petition is closed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
