O R D E R:

With the consent of both the parties, this Writ Petition is

taken up for disposal at the admissions stage itself.

2. This Writ Petition is filed under Article 226 of the

Constitution of India, seeking the following relief:

“...to issue a Writ, Order or direction more particularly one in the

nature of Mandamus, declaring the action of the respondents in not considering the Representation dated 18.08.2025 without considering the Judgment dated 27.09.2023 in O.S.No.710 of 2023 passed by the XIX Junior Civil Judge, City Civil Court, Hyderabad for grant of family pension is highly illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19, 21 and 300-A of Constitution of India and consequently direct the respondents to consider the representation dated 18.08.2025 in the interest of justice

and to pass...”

3. Heard Sri Dinesh Jaiswal, learned counsel for the petitioner; learned Government Pleader for Home for respondent Nos.1 and 2; and learned Government Pleader for Services-III for respondent

No.3.

4. Learned counsel for the petitioner submits that the petitioner is the legally wedded wife of the late Syed Shamsuddina and that they were blessed with two daughters. It is further submitted that the petitioner’s husband worked as a Section Officer, Home Department and retired from service. After retirement, the petitioner’s husband passed away on 06.06.2020, leaving behind

the petitioner and two daughters as his legal heirs. Subsequently, the petitioner approached the respondents for grant of family pension by furnishing all the necessary documents. However, the respondents informed the petitioner to furnish legal heir certificate. Therefore, the petitioner filed O.S.No.710 of 2023 before the XIX Junior Civil Judge, City Civil Court at Hyderabad. The learned trial Court, after hearing the matter, passed judgment dated 27.09.2023 by declaring the petitioner and two daughters as legal heirs of late Syed Shamsuddin. As such, the petitioner submitted a representation to respondent No.1 on 14.08.2025 requesting the grant of family pension and the same is pending consideration. Therefore, learned counsel prays this Court to direct respondent No.1 to consider the representation dated 14.08.2025 submitted by the petitioner and pass appropriate orders, within a stipulated period of time.

5. Learned Government Pleader for respondent Nos.1 and 2 submits that respondent No.1 will consider the representation of the petitioner dated 14.08.2025 and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.1 to consider the representation dated 14.08.2025 submitted by the petitioner and pass appropriate orders thereon, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
