TRANSFER CRIMINAL PETITION No.37 OF 2025

ORDER:

This Transfer Criminal Petition is filed under Section

447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner seeking to transfer the Charge Sheet in C.C.No.84 of 2021, on the file of the learned Additional Judicial Magistrate of First Class, at Kalwakurthy, to the file on any learned Metropolitan

Magistrate Court, Ranga Reddy District, at L.B. Nagar.

2. Heard Sri K. Venumadhav, learned counsel for the petitioner and Sri E. Ganesh, learned Assistant Public

Prosecutor for respondent No.1-State.

3. Learned counsel for the petitioner submitted that accused No.1 by using political influence threatening the petitioner/accused No.2 with dire consequences not to attend before the trial Court and also threatening to kill the petitioner herein. It is further submitted that the

followers and henchman of accused No.1 had kidnapped and bet the petitioner herein. It is further submitted that the petitioner’s son lodge a complaint before the police Kadthal against the accused No.1 and his followers in FIR.No.293 of 2024, dated 05.10.2024. It is further submitted that there is a life threat to the petitioner from accused No.1. Hence, he prayed this Court to transfer the Charge Sheet in C.C.No.84 of 2021, on the file of the learned Additional Judicial Magistrate of First Class, at Kalwakurthy, to the file on any learned Metropolitan Magistrate Court, Ranga Reddy District, at L.B. Nagar.

In view of the submissions made by the learned counsel for the petitioner, the only ground on which the petitioner is seeking to transfer the case from Kalwakurthy to Ranga Reddy District is that there is a threat to the petitioner in the hands of the accused No.1. Considering the same, the attendance of the petitioner herein is dispensed with and the petitioner is directed to appear before the trial Court through his counsel and whenever, the trial Court insists the petitioner to appear before the Court, the petitioner can appear through online.

5. With the above observation, this Transfer Criminal Petition is disposed of.
