WRIT PETITION No.14601 OF 2017

O R D E R:

This Writ Petition is filed under Article 226 of Constitution

of India seeking the following relief/s:-

“…Issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents police particularly respondents 5 and 6 registering multiple FIRs vide FIR No. 203/2017 dt. 09.3.2017 and Crime No. 41/2017 as shown in Custody Report against the petitioner and her company under Sections 406, 420 of IPC in connection with the same subject matter relates to the same incident in respect of same occurrence in connection with first FIR no. 261/2016 dated 26.12.2016 registered by the 4th respondent on the same sections and hence it is nothing but registration of multiple FIRs against the petitioner by the respondents 5 and 6 police knowing fully well and aware of the first FIR it is nothing but in violation of law and procedure and contrary to various judicial pronouncements including reported in 2013 (6) SCC 348 purely abuse of process of law thereby violation of fundamental rights under Article 14, 20 and 21 of Constitution of India thereby the registration of multiple FIRs vide FIRs vide FIR No. 203/2017 dt. 09.3.2017 and Crime No. 41/2017 as shown in Custody Report be treated as supplementary to the first FIR i.e., FIR No. 261/2016 and club

the same thereby multiple FIRs liable to be quashed and to pass..….”

2. None appeared on behalf of the petitioner.

3. I have heard Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent

Nos.1 to 6.

4. Learned Assistant Government Pleader for Home would submit that the contest of the petitioner as to registration of

multiple F.I.R’s. However, during pendency of the present petition, Crime No.203 of 2017 which was numbered as C.C.No.1160 of 2017 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad, ended in conviction and likewise, Crime No.261 of 2018 which was numbered as C.C.No.1344 of 2018 on the file of II Additional Chief Metropolitan Magistrate, Hyderabad, was ended in settlement between the parties before lokadalat and the offences were compounded on 22.08.2023. The other Crime No.41 of 2017 is numbered as C.C.No.1137 of 2018 and is pending for trial on the file of the XIV Additional Chief Metropolitan Magistrate, Nampally, and the matter is listed on 13.09.2025, thus, the cause does not subsist for consideration.

5. I have perused the materials on record.

6. The contest of registration of multiple F.I.R’s has been addressed, as two of the crimes have concluded in conviction and compromise respectively and the other crime is pending for trial.

7. Having regard to this development, this Court is of the considered view that the contention raised in this petition has become infructuous. Accordingly, this petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
