WRIT PETITION No.4389 OF 2020

ORDER

This Writ Petition, under Article 226 of the Constitution

of India, is filed seeking the following relief:

“...to issue a proper writ order or orders particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not issuing the Cheques for the amount under Rythu Bandhu Scheme to the petitioners Agricultural Lands to an extent of Ac.2.00 guntas in Survey No.317 to an extent of Ac.2.11 guntas in Survey No.481/AA to an extent of Ac.1.20 guntas in Survey No.327/E to an extent of Ac.0.15 guntas in Survey No.326 to an extent of Ac.4.38 guntas in Survey No.325 to an extent of Ac.6.23 guntas in Survey No.315/A to an extent of Ac.22.26 guntas in Survey No.316 and to an extent of Ac.5.10 guntas in Survey No.319/A total to extent of Ac.45.23 guntas situated at Kalakonda Village, Madgula Mandal, Ranga Reddy District while issuing the same to others including the petitioners brother is arbitrary illegal and discriminative and violative of Article 14 of the Constitution of India and consequently issue a direction to the respondents to issue the Cheques for the entitled amount to the petitioners

above said Agricultural lands and to pass...”

2. Heard learned counsel appearing for the petitioner, learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 4 and learned Assistant Government Pleader for Agriculture, for respondent Nos.5 and 6 and

perused the record.

Learned counsel appearing for the petitioner would submit the petitioner is the absolute owner and possessor of the agricultural land to an extent of Ac.2.00 guntas in Survey No.317, to an extent of Acs.2.11 guntas in Survey No.481/AA, to an extent of Ac.1.20 guntas in Survey No.327/E, to an extent of Ac.0.15 guntas in Survey No.326, to an extent of Acs.4.38 guntas in Survey No.325, to an extent of Acs.6.23 guntas in Survey No.315/A, to an extent of Acs.22.26 guntas in Survey No.316 and to an extent of Acs.5.10 guntas in Survey No.319/A, total to extent of Ac.45.23 guntas, situated at Kalakonda Village, Madgula Mandal, Ranga Reddy District. Recently, the Government of Telangana has introduced a scheme “Rythu Bandhu” for the benefit of the agriculturists. Under the said scheme the Government is paying Rs.5,000/- per acre as first installment and Rs.5,000/- per acre as second installment, total Rs.10,000/- per acre for the development of agricultural land as well as investment of raising the crops.

Petitioner made an application for issuance of fresh passbooks and also benefits under the Rythu Bandhu scheme along with his brother and after a great persuasion, fresh pattadar passbooks have been issued, but the cheques under the Rythu Bandhu scheme were not issued in spite of much efforts and repeated requests. The action of respondents in not issuing the cheques is arbitrary and illegal. Hence, the present writ petition.

Learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 4 would submit that since the representation made by the petitioner is dated 29.11.2019 and from then till now 6 long years have elapsed. Hence, seeks direction to the petitioner to make a fresh representation. Upon filing such representation, the respondent authorities will consider the same and pass appropriate orders in accordance with law.

Learned Assistant Government Pleader for Agriculture, for respondent Nos.5 and 6 by filing counter would submit that for granting Rythu Bandhu, the name of the petitioner has to be recommended by the Chief Commissioner for Land Administration (CCLA). Unless the name of the petitioner is recommended by the CCLA, respondent No.5 is handicapped in issuing the said scheme.

7. In the light of the aforesaid discussion, this Writ Petition is disposed of, directing the petitioner to submit afresh representation by enclosing all the relevant documents to respondent Nos.3 and 4 and it is for respondent Nos.3 and 4 to consider the same and pass ap
