2. The main challenge in the present Writ Petition is to the action of the 4^th respondent in issuing Look Out Circular against

the petitioner.

3. The case of the petitioner is that she was born and brought up in Hyderabad, and presently she is residing in United States of America(USA) and is a citizen of USA, and that she is

holding a valid passport.

4. Petitioner further submits that when her husband travelled to Hyderabad, India, to attend the Enforcement Directorate at Hyderabad to answer the summons and after attending the ED on 22.09.2023, when he intended to travel back to USA on 01.10.2023, the immigration officer at Calcutta Airport refused his entry and when enquired, informed that LOC has been issued against him and the petitioner herein, and that her

husband was arrested subsequent to the LOC issued in connection with ECIR bearing No.ECIR/HYZO/08/2023 and was enlarged on bail on 13.12.2023 vide Crl.P.No.12018 of 2024, and that the said ECIR was taken cognizance by the trial Court and is numbered as SC.No.66/2024

Petitioner further submits that that she is no way connected with the affairs of her husband nor any complaints making specific allegations against the petitioner are filed, and thus seeks to suspend the operation of the LOC issued against the petitioner and permit the petitioner to travel to India from USA and travel back to USA.

Learned Standing Counsel appearing for respondent No.4 has filed a memo, dt.27.08.2025 stating that without prejudice to the rights of the said authority, the authorities have no objection for suspension of the LOC for a limited and specific period, to enable the petitioner to enter India subject to the petitioner appearing before the 4^th respondent and cooperating with the investigation.

7. In view of the above, the Writ Petition is disposed of suspending the LOC issued against the petitioner for a period of six (06) months from today enabling her to travel to India. It is needless to state that the petitioner shall cooperate with the 4th respondent in conducting investigation as and when required. The 4^th respondent shall also indicate to the petitioner well in advance giving (07) days time specifying the date and time, for the petitioner to appear before the said authority, in connection with ECIR bearing No.ECIR/HYZO/08/2023. No order as to costs.

Consequently, miscellaneous applications, pending if any, shall stand closed.
