WRIT PETITION NO.24254 OF 2025

ORDER:

This Writ Petition is filed seeking a direction to respondents

No.2 and 3 not to close the gates erected at Gandhigunj Market Yard, Nizamabad and to grant access through the said gates to the

houses of the members of the petitioner association.

2. Heard Sri T.V.Kalyan Singh, learned counsel for the petitioner, learned Government Pleader for Agriculture, appearing for respondents No.1 and 2 and Sri N. Uma Shankar, learned Standing Counsel for Agriculture Market Committee, appearing on

behalf of respondent No.3.

3. Learned Standing Counsel for Agriculture Market Committee has produced the written instructions, wherein Para 5

and 6 state as under:

“The allegation of the Gandhi Gunj Building

Owners and Traders Welfare Association that the undersigned have closed both gates i.e., on the north and south and has cut off all the access to the residents and traders of Gandhi Gunj is not true as

the Gandhi Gunj is common way for people going from Gandhi Chowk to Dubba area and if both the gates are closed, not only the residents of Gandhi Gunj but also common people travelling to and from Gandhi Chowk to Dubba will also suffer as there will be severe traffic issues.

This office has placed barricades in front of gates to avoid heavy in front of unauthorized vehicles which are left for parking in the Gandhi Gunj for hours together. Further, with the suggestion of the traffic police this office has initiated this steps of placing Barricades in front of gates (Photos enclosed for kind perusal).”

In view of the above submissions, it appears that the respondents are not blocking the entry of the residents of that area but are trying to regulate the traffic and to prevent parking of the unauthorized vehicles in front of the gates. Therefore, this Court deems it fit and proper to dispose of this Writ Petition by directing the respondents to allow the access through the said gates to the members of the petitioner association and other residents of the area and not to block the same. However, this order shall not preclude the respondents from regulating traffic in the said area.

5. With the above directions, this Writ Petition is disposed of.

There shall be no order as to costs.

6. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
