ORDER

Heard learned counsel for the petitioner and

learned Assistant Government Pleader for Home.

2. According to the petitioner, the 3rd respondent seized two mobile phones of the petitioner on 17.03.2025 in connection with Crime No.522 of 2025 on the file of Gachibowli Police Station, without following the due procedure laid down under law. Challenging the said action of 3rd respondent,

petitioner filed the present writ petition.

On the other hand, learned Assistant Government Pleader for Home, on instructions, would submit that on the complaint lodged by Ms.Srujana Mamidi, R3 has registered a case in Crime No.522 of 2025 against the petitioner for the offence under Section 78 of the Bharatiya Nyaya Sanhitha (for short ‘BNS’). In connection with the said crime, during the course of

investigation, the Investigating Officer has seized two mobile phones from the petitioner, in accordance with law. The Investigating Officer had already deposited the said mobile phones before the learned Magistrate along with Form No.16 on 26.05.2025 and administrative officer is on leave, therefore ‘P’ number is given. Therefore, the petitioner has to file an appropriate application before the learned Magistrate either for interim custody or for release of said mobile phones.

In the light of the submission of the learned Assistant Government Pleader for Home, this Writ Petition is disposed of granting liberty to the petitioner to file proper application before the learned Magistrate concerned in Crime No.522 of 2025 pending on the file of P.S.Gachibowli, seeking interim custody/release of the said mobile phones and on such application being made, it is for the learned Magistrate concerned to consider the same and dispose of in accordance with law.

5. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
