THE HONOURABLE JUSTICE MOUSHUMI BHATTACHARYA,THE HONOURABLE SRI JUSTICE GADI PRAVEEN KUMAR
Chinthireddy Sandeep Reddy – Appellant
Versus
The State of Telangana – Respondent
WA 66/2026

HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HON’BLE JUSTICE MOUSHUMI BHATTACHARYA AND THE HON’BLE JUSTICE GADI PRAVEEN KUMAR WRIT APPEAL No.66 OF 2026 DATE: 09.01.2026 Between Chinthireddy Sandeep Reddy and three others …appellants And The State of Telangana, Represented by it’s Principal Secretary, Revenue Department, Secretariate Building, Hyderabad and five others.

... respondents Sri Avinash Desai, learned Senior Counsel representing Sri. M.Pranav, learned counsel appearing for the appellants.

Sri Ambati Sai Varun, learned counsel appearing for respondent No.5 JUDGMENT: (Per Hon’ble Justice Gadi Praveen Kumar)

1. The present Appeal is filed aggrieved by the interim order, dated 07.01.2026 passed in W.P.No.21961 of 2025 by the learned Single Judge, wherein it was recorded that the counsel for the petitioner was present, counsel for

respondent No.5 was present and respondent No.6 was also present and sought time for filing counter and the matter was accordingly posted to 11.02.2026.

2. The short question that arises for consideration before this Court is the contention of the learned counsel for the appellant that the learned Single Judge ought to have provided an opportunity of hearing to the appellant/writ petitioner before adjourning the Writ Petition without extending interim order, dated

28.07.2025.

3. It is a settled principle of law that when the interlocutory order had not attained finality, approaching the appellate Court violating arbitrariness cannot be entertained.

No.5 submits that pursuant to the interim orders, a mention was made at 1.30 p.m. as well as 2.15 p.m. seeking execution of the interim order, wherein, the learned Single Judge permitted the learned counsel for the writ petitioner to file an appropriate petition. In such circumstances, a petition seeking extension of interim order can be considered. Admittedly, no such application was filed. The impugned order reflects that no such effort or prayer was made. However, in view of the last working day and to meet the ends of justice, the interim order granted earlier is extended till 19.01.2026. However, this extension will not affect other cases. Learned counsel appearing for the appellant is permitted to make a mention by duly filing an appropriate petition seeking extension of the interim order.

5. Accordingly, the present Appeal, along with all connected applications, is disposed of without going into merits of the case. There shall be no order as to costs.
