ORDER:
This Writ Petition is filed with the following relief:
“…to issue a Writ or order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd Respondent in threatening the petitioner on 04-05-2019 to dispossess from the property admeasuring Ac. 5.00 Gts in Sy. No 36/69, situated at Fatehnagar Village, Navipet Mandal, Nizamabad District even before the lapse of Appeal period, without police aid and any execution proceedings in O.S. No 36/69, situated at fatehnagar Village, Navipet Mandal, Nizamabad District and be pleased to pass.......”
2. None appeared on behalf of the petitioners.
3. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5.
4. Learned Assistant Government Pleader for Home submits that the respondent police have never interfered in any civil dispute, as alleged in the writ petition, and that the allegations made against the respondent police authorities are baseless and unfounded. Accordingly, the learned Government Pleader prays for dismissal of the writ petition.
5. Learned counsel appearing for respondent No. 6 submits that, based on the report filed by the unofficial respondent, a crime was registered, and during the course of such proceedings, there was no occasion or necessity for the police to interfere with the petitioners. It is further submitted that the allegations made against the unofficial respondent are without any factual foundation. Hence, he prays that the writ petition be dismissed.
6. The contention of the petitioners is that the respondent police authorities, in collusion with respondent No. 6 (unofficial respondent), are interfering in matters of a purely civil nature.
7. Having considered the pleadings on record and keeping in view the well-settled legal position that the police have no authority to intervene in civil disputes except where criminal elements are involved, this Court directs the respondent police authorities to refrain from interfering in the civil dispute between the petitioners and respondent No. 6, except in strict accordance with law and by following due process.
8. With this direction, this petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
