ORDER:

Heard Sri G.Abdul Khader, learned Counsel appearing for the petitioners, Smt. S.Sravanthi, learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4, Sri Srinivas Rao Pachwa, learned Standing Counsel for GHMC appearing for the respondent No.5 and Sri Pramod Maligi, learned Counsel appearing for the respondent No.6 and perused the material on record.

Learned Counsel for the petitioners submits that this writ petition is filed by the petitioners seeking direction to the respondent Nos.2 to 4 to demarcate the public road which is in existence and further requested to direct the respondent Nos.3 to 5 not to merge the public road into the park which is arbitrary, illegal and in violation of Municipal Corporation Act.

Learned Counsel for the petitioners further submits that in spite of lapse of more than 3½ years, the respondents did not choose to file any counter in this matter for denying the averments made in the writ affidavit. Moreover, the respondent No.4 addressed a letter to the respondent No.5 in Lr.No.B/618/2020, dated 19.11.2020 and stating that as per the field inspection it is observed that the land in question has been demarcated with reference to the Village Map of Boduppal which fall under the land bearing Sy.No.28 of Boduppal Village of Medipally Mandal and as per Village Map, there was a road exits and passed through in Sy.No.50 and 51 of Boduppal Village presently it is covered by houses on ground.

Learned Counsel for the petitioners further submits that the respondent No.5 addressed a letter to the respondent No.4 in Lr.No.539/BMC/TP/2020, dated 24.12.2020 requesting the respondent No.4 to demarcate the road which exists and so as to take further necessary action in the matter. In view of the same, the respondent No.4, without conducting survey as requested by the respondent No.5, is continuing the illegal construction of the road existing in the suit schedule property. Hence, requested to direct the respondent Authorities to conduct survey as per law.

5. On the other hand, the learned Counsel for the respondent No.6 submits that the respondent No.6 is no way concerned about the allegations of the petitioners. Moreover, the writ petitioners themselves have occupied the road without any permission. If the official respondents want to conduct survey in the presence of the petitioners as well as the unofficial respondent, the respondent No.6 has no objection.

Learned Assistant Government Pleader for Revenue submits that the respondent No.4 will take necessary steps to conduct survey as per the letter addressed by the respondent No.5 to the respondent No.4 dated 24.12.2020 by issuing notice to the affected parties and requested to pass appropriate orders.

In view of the submissions made by both sides, the writ petition is disposed of directing the respondent No.4 to conduct joint survey by issuing notice to the concerned municipal authorities, as well as the petitioners and the unofficial respondent and demarcate the road as per the records and take further action as per law. There shall be no order as to costs.

8. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
