O R D E R :

This Writ Petition is filed under Article 226 of the Constitution

of India, seeking the following relief:

“…to issue a writ or order or direction more particularly one in the nature

of writ of mandamus declaring that the inaction of the respondents in

considering my representations dated 15/12/2025 for consideration of my

Promotion to the post of Royal Inspector though my name is in Seniority

List at serial no.3 on the sole ground of pendency of disciplinary

proceedings as arbitrary, unlawful, violation of principles of Natural

Justice, against to the GOMs No.257, General Administration (Service-C)

Department dated 10-6-1999 and GOMs No.175, GAD dated 21/8/2025

and against to the fundamental rights guaranteed under the Indian

constitution and consequently direct the respondents to consider petitioner

representation dated 15/12/2025 for the Promotion to the post of Royal

Inspector without reference to the pending disciplinary proceedings…”

2. Heard Mrs.Ande Vishala, learned counsel for the petitioner and

learned Government Pleader for Services-III for the respondents.

With their consent, this Writ Petition is taken up for disposal at the

admission stage itself.

3. Learned counsel for the petitioner submits that the petitioner is

presently working as a Technical Assistant and is fully qualified and

eligible for promotion to the post of Royal Inspector. However, the

respondents are not considering her case for promotion solely on the

ground of pendency of departmental proceedings initiated pursuant

to the charge memo issued vide G.O. Rt. No.198, Industries and

Commerce (Vigilance) Department, dated 30.12.2024. It is further

submitted that the petitioner submitted her written explanation on

13.02.2025, but without considering the same, an enquiry was

ordered. However, there is no progress in the said enquiry. As such,

learned counsel prays this Court to direct the respondents to

consider the case of the petitioner for promotion to the post of Royal

Inspector in terms of G.O.Ms.No.257, General Administration (Ser.C)

Department, dated 10.06.1999.

4. Learned Government Pleader appearing for the respondents

submits that, in view of the pendency of departmental proceedings

against the petitioner, she is not entitled to promotion. However, the

respondents will consider the petitioner’s case for promotion to the

post of Royal Inspector in terms of G.O.Ms.No.257, General

Administration (Ser.C) Department, dated 10.06.1999.

5. Having regard to the submissions made by the learned counsel

appearing for the respective parties and without expressing any

opinion on the merits of the case, the Writ Petition is disposed of,

directing the respondents to consider the case of the petitioner for

promotion to the post of Royal Inspector in terms of G.O.Ms.No.257,

General Administration (Ser.C) Department, dated 10.06.1999, as

and when promotions are effected.

Miscellaneous petitions, if any, pending in this Writ Petition

shall stand closed. There shall be no order as to costs.
