ORDER:

This writ petition is filed questioning the action of

respondent authorities in not instructing respondent No.6 not to

open wine shop, proposed to be opened at D.No.7-1-520, located

by the side of BC Study Circle, in the same lane of Educational

Institutions such as Girls High School, Co-education High

School and within 80 meters of Anjaneya Swamy Temple and

that the students, ladies, children and other residents of

Mankamma Thota will suffer badly due to nuisance likely to be

created by the liquor consumers, the present writ petition is

filed. A consequential prayer is sought to direct respondent

authorities to instruct respondent No.6 to shift wine shop,

proposed to be opened at Door No.7-1-520 to some other place.

2. None appears for the petitioner.

3. When the matter is taken up for hearing, learned Assistant

Government Pleader for Prohibition & Excise submitted that

license was given to respondent No.6 for a period of two (02)

years with effect from September, 2019 to September, 2021 and

as such license period issued to respondent No.6 is expired and

the cause in this writ petition does not survive for adjudication.

4. Recording the submission of learned Assistant Government

Pleader for Prohibition & Excise, this Court deems it appropriate

to dismiss this writ petition as infructuous, as the cause in this

writ petition does not survive for adjudication.

5. Accordingly, this writ petition is dismissed as infructuous.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any

pending in this petition, shall stand closed.
