ORDER:

This Transfer Criminal Petition is filed under Section

447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for

short, ‘BNSS’) by the petitioner who is the defacto

complainant, seeking to transfer the case in S.C. No.8 of

2023 on the file of the Principal District & Sessions Judge,

Mulugu to Principal District & Sessions Judge,

Hanamkonda.

2. Heard Sri Challa Srinivas Reddy, learned counsel for

the petitioner and Sri Arun Kumar Doddla, learned

Additional Public Prosecutor appearing for respondent

No.1–State.

3. Learned counsel for the petitioner submitted that the

petitioner is a native of Hanamkonda and that the

witnesses also belong to Hanamkonda. It is further

submitted that in order to depose against the accused,

they are required to travel to Mulugu by crossing forest

areas, which causes serious difficulty and apprehension,

as the witnesses are facing threat at the hands of the

accused.

4. On the other hand, notice has been served on all the

respondents, but only respondent No.4 appeared and

stated that he has no objection to the transfer of the case.

5. Considering the submission of the learned counsel

for the petitioner that the witnesses in S.C. No.8 of 2023

are under threat from the accused, the case is withdrawn

from the Court of the Principal District & Sessions Judge,

Mulugu, and transferred to the Court of the Principal

District & Sessions Judge, Hanamkonda.

6. Accordingly, this Transfer Criminal Petition is

allowed.

Miscellaneous applications, if any, pending in this

petition, shall stand closed.
